RE: Consider approval of Change Order #1 for the Bethel Road Reconstruction Project
SS 94 -02CST in the amount of $93,960 to Pavecon, Inc.; and authorizing the Mayor
to sign.
During the reconstruction of the trench line along the south side of Bethel Road, the City of Coppell was
contacted by the owner of the property at the northeast corner of Royal Lane and Bethel Road. The initial
inquiry was to ascertain whether or not the City of Coppell would allow truck traffic on Bethel Road once the
reconstruction was completed. After the property owner was informed that truck traffic would not be allowed
on Bethel Road, they then inquired whether or not the City would allow the property owner to fund a road
surface that would allow truck traffic. The property owner was informed that if it fit our timetable that we
would allow the property owner to fund the reconstruction of Bethel Road that would allow truck traffic.
After conversations with the contractor and the determination that the minimum section would be an 8"
stabilized base with a 6" hot mix overlay, the property owner to the north stated that they would fund the
additional costs. On February 4, 2000, I provided a letter to the property owner stating that if they paid for the
reconstruction of Bethel Road for approximately 870 feet east of the Royal/Bethel intersection, then the City
would allow truck traffic up to that point. While no plans have been submitted for the development on the north
side of the roadway, the property owners initial layouts indicate that once developed it is highly likely there
would be a driveway approximately 870 feet east of Royal Lane on Bethel Road. This location aligns with a
drive approach to the Bulk Postal Facility on the south side of the roadway.
The cost to reconstruct 870 feet of Bethel Road is $93,960. A commitment letter was provided on February 8,
2000 stating that the property owner would make payment to the City of Coppell in the amount of the understanding that truck traffic would be allowed on that section of Bethel Road. On February 1960 2000, with
the property owner to the north provided a check to the City of Coppell in the amount of $93,960 for the
reconstruction of Bethel Road for approximately 870 feet east of Royal Lane. Again, the reconstruction will be
8 inches of subgrade material, with 6 inches of hot mix. This is a typical roadway section which should hold up
under truck traffic until the road is reconstructed to its permanent configuration. You may recall that this is one
of the roads approved in the November 1999 Bond Election by the citizens of Coppell.
Because the entire change order has been paid by the property owner to the north at no cost to the City and
because of the City's desire to expedite the construction and proceed with this project, the City of Coppell has
instructed the contractor to proceed with this work. Therefore, the City anticipates this project will still be
completed within the initial timeframe i.e., toward the end of February or the first week of March.
Staff recommends approval of Change Order #1 to the Bethel Road Reconstruction Project in the amount of
$93,960. Staff will be available to answer any questions at the Council meeting.

required for the performance of the following described work in
connection with construction or improvements at above address.
REBUILDING A SECTION OF BETHEL ROAD IN COPPELL
The work is to be performed as follows:
EXCAVATE APPROX. 14" DEEP, PLACE 8" CTB BASE, PLACE 4" TY "B" BASE ASPHALT
AND PLACE 2" TY "D" SURFACE MIX.
APPROXIMATLY 2,320 SY @ $40.50 PER SQUARE YARD = $ 93,960.00
Owner shall be responsible to locate all buried utilities lines and sub
structures, and to clearly identify and mark all lines and sub
structures, by calling 1 800 - DIG -TESS prior to commencement of the work
by PCM. By accepting this proposal, Owner agrees to indemnify and to
hold PCM harmless from all claims, including its reasonable attorneys'
fee incurred in defending any claim, resulting from damages to any
utility line or sub structure not identified or clearly marked. If
owner shall clearly mark all utility lines or sub structures and such
lines or sub structures are damaged by PAVECON, INC. PAVECON shall
assume responsibility for all repair costs associated with any damage
to such buried items.
Cost of City permits (if applicable) are not included in total cost and
will be paid by owner.
If the foregoing meets with your acceptance, kindly sign and return the
attached copy of our proposal. Upon its acceptance it is understood
that the foregoing, including the terms and conditions set forth and
attached hereto and incorporated herein for all purposes, will
constitute the full and complete agreement between us.
