Pm not really interested in sitting at their building looking at plans that they guard as if we are trying to
steal trade secrets. I've already did that once. I need the plans so I can study them and be able to
formulate intelligent responses when I get calls about the RFQ's. I also need to review them to even
know what the scope of services are that I need to ask consultant firms to propose their services for.
I guess I'll need to go higher to try and get the plans.

Do you have an attorney contact that maybe could convince Luminant to give us copies of the dam
plans? I'm reluctant to ask for RFQ's without having time to study the plans and provide plans to firms
so they can determine their approach to the design and the scope of work. Luminant only wants to
allow us to go to their office and review the plans under their watchful eye.

Kyle Ray with Luminant delivered the dam documents (6 discs) and I will get them to you today. The discs
marked "Dam Reports w /Easy Guide" and "Northlake Environmental File Discs 1- 4" each have an installer
option that might require the assistance of your IT guy, but we were able to open them just fine.
Therefore, per 3.(a) of the Omnibus Amendment 10/28/09., the seventy -five (75) calendar day period will start
running tomorrow. In addition, the confidentiality agreement we signed with Luminant still applies to us and
our assigns so please keep that in mind as you disseminate this information.

I believe we will need to extend for a number of reasons. The primary reason concerns Oncor's
announcement at the last meeting that it may be 5 - 10 years before they raise the plant. I believe our
obligations to lower the lake and dam do not take effect until that time. Am I missing something?
