CITY OF COPPELL
HOLD HARMLESS AGREEMENT
WATER MAIN CONNECTION
WHEREAS , Billingsley Development Company (and its affiliated entities) is the Owner
Developer of the property adjacent to the east side of Belt Line Road, known as Cypress
Waters; and
WHEREAS, Billingsley Development Company has contracted with Gracon
Construction to construct City of Dallas water facilities and water line to serve the
Cypress Waters development; and
WHEREAS, the City of Dallas is in the process of preparing an interlocal agreement
between the City of Dallas and the City of Coppell providing for a water line connection
to an existing City of Coppell water line located along the west side of Belt Line Road,
which connection is to be metered and provide for temporary construction water service
to a Phase I development and a permanent emergency water service connection; and
WHEREAS, permanent water service from the City of Dallas must be provided to the
Phase I Cypress Waters development prior to issuance of Certificates of Occupancy for
any of the structures constructed, and
WHEREAS, Gracon Construction has reached a critical stage of construction for
physically making this water connection.
NOW THEREFORE, it is agreed that Gracon Construction may proceed with
• constructing this temporary water connection in advance of final execution of the City of
Dallas interlocal agreement with the City of Coppell, subject to the following:
1. Billingsley Development Company will hold the City of Coppell harmless from
any associated costs and for any damages to existing City of Coppell facilities that
might arise during the course of this construction.
2. No water may be used from this connection until the formal interlocal agreement
between the City of Dallas and the City of Coppell is executed.
