Dear Mr. Allen:
We have been requested by the City of Coppell to verify your
September 20, 1988 damage claim for an irrigation system along
Denton Tap Road. We have discussed this issue with L.H. Lacy
Company, the City's contractor for the project, who has no
knowledge of the damage. Since L.H. Lacy Company has, in most
cases, contacted the adjacent property owners and made repairs or
modifications to several irrigation systems, there seems to be
some doubt as to who is responsible for the damage you have
suffered. As you know, several utility companies have been
working in the area adjusting and relocating utilities which
conflict with the paving or storm sewer improvements which are
under construction.
In order to determine who is responsible for your irrigation
system damages, we suggest that you or your representative
contact our field representative, Mr. Randy Fleming, at 393-2355
and set up a meeting with him and L.H. Lacy Company at the site
of the damage. If L.H. Lacy Company is responsible for the
damage, they will pay your claim.
If you should experience similar damage in the future as a result
of construction of City of Coppell Capital Improvements Projects,
we suggest that you file your claims directly with the Contractor
while furnishing copies to the City for their records.
