Box 478 Coppell, Texas 75019 Re: Denton Tap Road Improvements from Belt Line Road to Sandy Lake Road - Ronald Van Ness Dear Mr. Ratliff: We have reviewed Mr. Van Ness' letter of May 22, 1989 to you regarding access from Meadowcreek Drive to Denton Tap Road. Mr. Van Ness is quite correct concerning the difficult access situation and the promises made and then ignored by the Contractor. Mr. Van Ness is in error in his statements about the efforts of this firm in administering the project. We want to assure you that we have made every effort within our power to resolve the current situation, but have not promised Mr. Van Ness anything beyond the fact that we will try to urge the Contractor to fulfill his promises and that we will also try to keep Mr. Van Ness informed of any developments regarding this situation and others affecting his properties. We understand the frustration of the citizens, businesses, and property owners along the project. We try to work out the problems that arise within the contractual limitations set forth in the Agreement between the city of Coppell and L. H. Lacy Company. The Contract does not permit us to dictate the Contractor's sequence or scheduling of his work beyond the enforcement of terms regarding the total Contract Time which is included in the Contract. This situation is very frustrating to us also, but "it comes with the territory" and we will continue to give our best efforts in seeking expeditious solutions to the problems that arise. As per your request we have prepared, and are submitting herewith, a draft response to Mr. Van Ness under your signature.
