Box 478 Coppell, Texas 75019 D~ar Mayor Brown: The First Security Bank & Trust~Company has informed us that they donated their bank building located at southwest corner of the intersection of Coppell Road and Belt Line Road at Coppell, Texas to the City of Coppell (hereinafter referred to as the "City")~on December 31, 1982. It is our understanding that the City plans to relocate said building to a permanent site owned by the City, but desires to let the building remain at its current location on property owned by the Southwestern Town Lot Corporation (hereinafter referred to as the "SWTL") until its permanent site is ready to accommodate said building. As an accommodation to the City, the SWTL hereby permits the City to temporarily occupy its property for storage of said building under the following express terms and conditions: 1. No active use shall be made of the building while it is being stored on said property.. 2. The City's right.to store said building on said property shall extend for a period of one year from the date of execution of this agreement by the City with the understanding, however, that the SWTL shall have the right to revoke such right upon giving thirty (30) days written notice to the City. 3. The City, at its sole cost and expense, shall be responsible for removing'the building and all ancillary improvements from said property and clearing and restoring said property to the satisfaction of the SWTL. 4. The City hereby agrees to protect, save harmless, and indemnify SWTL and all of its affiliated companies from and against all liability cost and expense from loss or damage to property and for injury to or deaths of persons when arising or resulting from The Honorable Mayor Andrew Brown February 22, 1983 the use of said property by City, its employees, agents, licensees, contractors or invitees, whether or not caused or contributed to by any act or omission of the SWTL, its employees, agents, licensees or invitees. Please indicate your acceptance of the terms and conditions outlined above by signing and returning one copy of this letter to this office. I appreciate the cooperation the City has extended to us in our development efforts, and hope that this letter will serve to accommodate the City's needs.
