Dear Mr. Weber:
This letter is written in response to your June 1, 2001 letter requesting an extension of time due to a
Verizon duct that was in conflict with the proposed construction. Your letter states that the conflict
negatively affected the progress on the critical path of the project and that time should be suspended as of
MaY 31, 2001 and resumed once the conflict was resolved.
The specifications for this project state that no extension of the contract time shall be allowed unless the
contractor can demonstrate the delay caused an adverse impact to the critical path and that loss of time
cannot be made up by revising the sequence of the work on the project.
The latest construction schedule that I have is dated February 17, 2001. That schedule shows the
construction of the southeast quadrant to take approximately 41 days. It also shows that the construction
of the southeast quadrant is on the critical path for the completion of this project. The schedule further
shows that the completion of the southeast quadrant was scheduled for June 11, 2001.
Before I can process your request for an extension of time please provide the following information:
1. Did the conflict cause an adverse impact to the critical path such that time was lost that could not be
made up by revising the schedule? This needs to be quantified.
2. Did the conflict cause construction of the southeast quadrant to extend beyond forty-one days? Please
provide the exact time of when construction commenced and was completed.
Again, just because there was a conflict does not necessarily necessitate the extension of time for this
project. The above items need to be provided before I can consider an extension of time to the project.
Please provide this information in a timely manner so that this issue can be resolved. If you should have

Dear Mr. Griffin:
As you are aware EBCC's excavation crew has started phase 1 work on the MacArthur/Sandy
Lake intersection. On May 31, 2001, our crew encountered a Vefiz~n duct that is in conflict with
the proposed improvements in this phase and will probably be in conflict with future phases of
the intersection. This conflict negatively affects progress on the critical path for the project;
therefore, time charges need to be suspended as of May 31, 2001 and resumed once the conflict
has been resolved. To maintain progress on this intersection, it is imperative that Verizon clears
this conflict as sOOn as Possible and Clears all of their other lines prior to the start of a phase.'
