Dear Mr. Holmes:
At the March 9, 1999 City Council meeting, City Council approved zoning change PD-176 for the
McMillan Estates and tlie'associated minor plat. The exhibits presented at the City Council meeting did
not show enclosing the existing ditch between the proposed location of the home and the proposed location
of the pool. Ken Griffin, City Engineer has reviewed option 2 of the grading plan presented to the
Planning Depa[hnent and it appears that utilizing typical construction techniques will require the removal
of approximately 10 trees along the general location of the proposed box culvert. Those trees range in
size from a six-inch cedar to a 24-inch oak, for a total of approximately 128 caliper inches of trees to be
removed. It is quite possible with the utilization of different construction techniques, sloping, tree wells
or even maintaining some type of depressed overland flow along the south side of the proposed box
culvert some of those trees could be saved. However, that determination obviously cannot be made until
a detailed site-grading plan is submitted.
To start the process to gain approval of the installation of the box culvert across the property, the
following items will need to be addressed:
A flood study will need to be submitted which shows the impact of the placement of the box culvert
and the associated filling of the low area.
A revised site plan showing the box culvert and the associated removal of trees will need to be
submitted for Planning & Zoning Commission and City Council approval.
Engineering plans will need to be submitted and approved.
There was discussion at the March 9, 1999 City Council meeting concerning the ditch, tree removal, and
potential box culvert. However, the site plan submitted and the site plan approved by City Council did
not include the installation of a box culvert and the associated removal of the trees. Therefore, as
previously stated, to accomplish the placement of the box culvert the three items listed above will need to
be complied with.

request a clarification on the McMillian Estate zonin~ and.plat reipest on March 9, 1999.
The City Council up~nlmolisly approved the attached site plan for the Mc, Milh'ans to build
a home and a cabana/pool in the rear.portion of their lot. The oabana/.pool area is
currently in the Hood Plain. Therefore, it must be raised out of the Flood Plain and
approved by the City ~ and F.E.M.A..pfior to oonstmotion.
Between the house location and the pool is a ditch (or draw) that is as deep as nine feet in
some areas. Our recjuest is thatlmmission be IFanted by the city to extend the fifty-four
inch pipe that comes to our proper~ from the west to the creek. The pipe design shall
elbow down immediately so as to disturb as few trees as lmssible.
The Mcbffllians have always wanted the pipe extended, however we did not show this on
the site plan. This was done so that it would not be mandato~ should it be cost
prohibitive. However, we thought it was dearly understood that we wanted this as an
option.
This ditch is unpractical and very dangerous, which small chi~.dren could easily, fall into.

City Engineer Ken Cvriffith testified during the City Council Meeting saying thai the city
has always demanded that this ty~e of ditch have a concrete.pij~e and be oovered~ with the
one exception in Country Estates.
