RE: Floodplain Information (John Adams Tract of Land)
Dear Mr. Jackson:
This letter is written as a follow-up to our telephone conversation in which you inquired about the ability
to reclaim large portions of the referenced property that are currently contained within the floodplain and
floodway. As I stated in our telephone conversation, it is not entirely out of the question for portions
of the property to be reclaimed. However, it would be very prudent for your Engineer to obtain a copy
of the City of Coppell Floodplain Ordinance #94-639 as adopted on March 8, 1994 and review it to
determine exactly how much of the property could be reclaimed.
With this letter, I am including portions of the Floodplain Ordinance that cover several issues that I have
mentioned to you that will restrict the reclamation of the entire tract of land. The two most critical issues
are rise in water surface and valley storage. On the valley storage issue, the City requires that valley
storage reduction shall not exceed 15% for the 100-Year flood and 20% for the standard project flood.
This requirement could come into play even if you can meet the no rise in water surface. The other issue
is that in a fully developed watershed the City does not allow any rise in water surface. Also, when
dealing with the floodway, it should be noted that it has to be evaluated on an equal conveyance
encroachment i.e., this means even if you could develop your property and meet the requirements, you
still have to evaluate your property under the assumption that the property owner on the opposite side
of the creek has the same rights that you do for a reclamation.
Again, I am recommending that whomever will be evaluating this property for you obtain the entire copy
of the Floodplain Ordinance to get a more accurate determination of what can or cannot be reclaimed
from this property.
