Re: John Adams Drainage Easement
Dear Mr. Gay:
The City Manager of the City of Coppell has asked me to respond to you letter
of January 21 concerning your request that the above mentioned easement be dedicated
to the City of Coppell upon completion of the drainage improvements which are to be
constructed by Shell Oil Company.
Mr. Alan Ratliff, City Manager, is of the opinion that the drainage improvements
to be constructed by Shell Oil Company on the private easement are not improvements
that the City should accept for maintenance purposes.
I have reviewed the City's flood plain ordinance, Ordinance No. 87-390, and do
not find any provision in the ordinance which would require the City to accept and
assume maintenance responsibility over this area on the John Adams property. I would
be pleased to review any specific section of this ordinance or any other city or state
regulation you might wish to point out in support of your contention that the City is
obligated to take on this responsibility.
