Drainage Easement

Your presents at the meeting of May 24, 1988 was appreciated
and we trust that you have had time to review the drainage matter
since that date.
At the meeting you seemed to take a position that the city
has no liability to Mr. Adams. It is my theory that the city has
an obligation to all landowners regarding drainage. The
Indemnity agreement represents only a part of your
responsibility.
In your case the city would seem to have a dual
responsibility in that the city has been appointed to provide
comprehensive management of the floodplains in the city.
At the meeting, all parties were given until September 15,
1988 in order to take some positive action toward a satisfactory
resolution of the matter. In the event the matter is not
resolved to the satisfaction of Mr. Adams by that date, a suit
will be filed on the 16th with the city as a party.
if you desire to avoid the.litigation, you should kava ample
time to take action by the 15th of September. If you have any
suggestions or desire to discuss the matter in more detail,
please give me a call.
