Box 478 Coppell, Texas 75019 214-462-0022 Bob Finley Finley Development 16801 Addison Road, g250 Addison, TX 75248 RE: Ashton Ridge Erosion Control Dear Mr. Finley: Over the past several months, the City has approached you regarding problems with erosion control on the referenced project. You responded by taking additional measures to prevent any future failures of the erosion control. With the failure of the past erosion control, silt has been deposited in the City's drainage systems and the drainage channel which is in a City's drainage easement. The City has been contacted by a Bill Hines, representative of the Parks of Coppell Homeowner's Association, about his concern for the silt being deposited in the drainage channel. He has stated that he has seen the discoloration of the channel due to silt from your development. As per the City's Erosion and Sedimentation Control Ordinance//91514, Section 15-8-2 B, "A public erosion nuisance is an occurrence where erosion and/or sediment from one location causes an unsafe, bothersome, or unsightly condition on public property and public rights-of-way ... which includes silt, mud or similar debris, originating on one property but being deposited onto a second off-site property which is public property or public rights-of-way from which the City of Coppell may have to remove or clean up the deposit due to liability, statutory, aesthetic, drainage or property damage concerns." As stated in Sec. 15-8-1A, "The City of Coppell has in the past experienced significant soil erosion and sedimentation problems. Large quantities of earth have been displaced from private property onto drainage easements, storm drains, and other public places, access easements, public easements and public rights-of-way. Erosion is a dangerous activity in that it contaminates water supplies and water resources. Excessive sedimentation clogs water courses, drainage easements and storm drains and causes flooding which results in substantial damage to public and private lands. These problems result in a serious threat to the health, safety and general welfare of the community." On Wednesday, November 6, 1996 I spoke with you about this issue. In the discussion there where a couple of suggestions presented to you on how to begin to resolve the sedimentation in the Parks of Coppell drainage channel. Listed below are two possible ways discussed to resolve the issues: 1) It is the City's understanding that Centex Development is talking to the Parks of Coppell Homeowner's Associations about dredging the channel. If this is to happen, then a letter from Centex agreeing to be responsible to remove siltation deposited from the Ashton Ridge Development could be a possible solution. 2) Additional money could be deposited with the City in an amount to cover the cost of dredging the channel while negotiations continue with the Parks of Coppell. If you still believe that the siltation deposited from your development is minimal and has no effect on the drainage channel then sample borings need to be taken to verify the depth of the siltation.
