RE: Proposed Relocation of Existing City of Coppell Sanitary Sewer
Force Main onto Property Owned by St. Joseph Village, Inc. ("SJV") c~-
Dear Mr. Griffin:
We been made aware that the City of Coppell (City) wishes to construct a new
sanitary sewer force main to replace an existing, smaller force main currently in
an easement adjacent to the west line of SJV property. We further understand
that for ease of construction and future maintenance, and the elimination of
disruption to improvements presently existing in the current easement, the City
would like to construct the proposed force main in a new easement to be
dedicated by SJV inside and along its west line.
SJV is agreeable to the construction of the proposed force main, and dedication
of the necessary easement, on its property subject to the following conditions:
1. The City recognizes that SJV intends to develop its property into a continuing
care retirement community, St. Joseph Village ("Project"), in accordance with
a Site Plan pending approval by the City. This Site Plan defines an internal
roadway that is to be constructed along and over the land to be dedicated for
the proposed force main. Our Consultant has met with the City's Public
Works and Engineering Department staff, and has pointed out that beneath
this roadway; water, sanitary sewer, and storm sewer lines will be constructed
to support the Project. Therefore, the easement to be dedicated for the
proposed force main must also allow within its limits the construction of those
utilities necessary for the Project. These utilities may include, in addition to
those listed above, telephone, electronic cable, electric power, and gas.
Attached is a preliminary drawing that generally shows our understanding of
the size and location of the proposed force main and easement, and its
relation to future SJV improvements.

2. The City agrees to coordinate the design of the proposed force main with
SJV's Consultant to eliminate any conflict with the future SJV improvements
in and adjacent to the easement to be dedicated. Specifically, the City will
design the proposed force main to be at an elevation below any of the future
SJV utilities. The City further agrees to allow SJV's Consultant to review and
comment on the preliminary and final designs of the proposed force main
prior to advertisement for biding and construction.
3. The City agrees to schedule construction of the proposed force main so as
not to delay construction of the improvements to serve the Project.
4. The City agrees to indemnify and hold harmless SJV and its Consultant from
any and all claims of injury or damage that may occur to any party resulting
from construction of the proposed force main.
5. The City agrees to indemnify and hold harmless SJV and its Consultant from
any and all claims of injury or damage that may occur to any party resulting
from future maintenance or repair of the proposed force main.
6. The City agrees that any improvements, including landscaping, constructed or
installed by SJV in or adjacent to the proposed force main easement that are
damaged as a result of future maintenance or repair operations to the force
main will be fully restored or repaired by the City.
SJV realizes the importance of the proposed force main to the City and the
citizens it serves. At the same, we respectfully submit that the conditions
stipulated above reflect prudence on our part to minimize any negative impact to
our Project. Please advise us on the form of instrument you prefer to dedicate
the proposed force main easement. We and our Consultant are available to
meet with you and your staff at any time to review or discuss any relevant issues.
