Hi Brett:
I need to furnish evidence to Darling Homes that the final grades we deliver for the patio home lots meet HUD
guidelines.
Since the City’s contractor will complete their work and then our own contractor will install any necessary retaining
walls and finished lot grading, it’s a little unusual.
I don’t know the logical way to do this. Do you guys offer this service or do I need to use my own geotech?
I usually use Reed Engineering but if the City is using another firm, I don’t think that would work?
We still plan to have F&N begin immediately with platting the home lots as soon as the City goes firm with us in
November. It would be our preference to have finished grading plans available to the City’s contractor and have
finished lots as soon as possible.
I was also planning to have my geotech bore the sites as soon as the City’s grading work is finished.
If you could give us a suggestion or solution, that would be great.

Our engineering requirements for the Darling contract are attached in bold type.
This is why it’s critical for us that we use your testing lab. Once you make a selection, we will ask them for a
proposal as well.

"Substantial Completion", with respect to the Subdivision, is defined to mean that
each and all of the requirements listed below have been met and/or delivered to and
accepted byPurchaser, as applicable, with respect to the Subdivision and all of the Lots:
(a)Installation of an adequate and functioning water source and distribution system,
sanitary sewer system, and storm sewer and drainage system servicing each Lot, all in
accordance with the standards and specifications imposed by the Cityand any
applicable Governmental Authorities.
(b)Installation of concrete streets with curb and gutter fronting all of the Lots in
compliance with all governmental authorities.
(c)Permanent electrical service is available to the Lots.
(d)All Lots have been staked with iron pins at the corners.
(e)Seller has furnished to Purchaser a copy of a letter from the geotechnical
engineer for the Subdivision, certifying that fill was placed in accordance
with HUD/FHA Circular 79g.
(f)Seller has furnished to Purchaser a final geotechnical investigation report of
the Lots.Without limiting the foregoing, the Final Soils Report shall indicate,
among other things, that the Lots have a potential vertical rise ("PVR") not
to exceed 4.5 inches and shall include the Post Tensioning Institute PVR
criteria and parameters.
(g)Seller has constructed all retaining walls as required by the Lot Grading
Plan.
(h)Seller has furnished to Purchaser a set of the final Compaction Reports for
the Lots.
(i)Seller has furnished to Purchaser one (1) .dwg file of the recorded Final Plat,
one (1) reproducible mylar of the recorded Final Plat and three (3) prints of
the recorded Final Plat, including recording information.
(j)Seller has furnished to Purchaser a reproducible copy of the "As Built"
grading and development plans, showing paving, water, sewer, storm
drainage and utility layouts including drainage patterns, elevations at the
corners of Lots, elevations of the finished pads, and the elevation of the
highest point of the swale on each Lot.
(k)Seller has furnished to Purchaser a copy of the recorded Deed
Restrictions/Restrictive Covenants, information concerning any related
homeowners' association, and any architectural design guidelines that may exist,
including recording information for the foregoing.
(l)Seller has furnished to Purchaser a reproducible copy of the Address Plat or
Address List.
(m)Seller has furnished to Purchaser a Phase I Environmental Site Assessment.
(n)Building permits shall be obtainable for each Lot and, provided Purchaser
constructs a home on the Lot in compliance with applicable laws, recorded
restrictions and required design guidelines for the Subdivision, Certificates of
Occupancy will be obtainable for such homes.
(o)The Lots have been reasonably cleared of any trash, debris, or brush.
(p)Each Lot has been graded to a level within three-tenths foot (0.3 foot) of the
level set forth on the grading plan contained in the "As Built" Development
Plans. Each Lot has been graded so that (i) no significant fill or compaction
work shall be required to render such Lot buildable, (ii) Purchaser is not
required to install any retaining walls on the rear or along the side property
lines of any Lot, and (iii) the Lots have adequate drainage for the
construction of houses thereon. All swales and other drainage features of the
Lots shall maintain at least a 1% slope to allow for property drainage on
each Lot; Seller shall deliver to Purchaser a letter from Seller's engineer
that the foregoing is in substantial conformance to the plans.
(q)Seller has provided information to third parties as necessary for establishing
telephone and cable television service to all Lots.
(r) Gas service is available to the Lots.
(s)If required by the City for the issuance of building permits to the Purchaser for
any of the Lots, the Seller shall have installed applicable street lights and street
signs in the applicable portion of the Development containing Lots purchased by
the Purchaser.
(t)Seller shall construct and install all erosion control materials, improvements and
systems as required by applicable laws and all applicable Authorities, including,
but not limited to, the City and the Texas Commission on Environmental Quality
("TCEQ") (collectively, the "Erosion Control Measures"); provided, however,
Purchaser shall be responsible for implementing all Erosion Control Measures for
each Lot purchased by Purchaser from and after the date on which Purchaser
purchases any such Lot.
(u)The City has completed the widening of W. Bethel Road, and all street lights,
sidewalks, utilities and landscaping on W. Bethel Road, from Denton Tap to
Freeport Parkway.
