That was our initial reaction without having seen W&M’s information about the plume area and venting recommendations. Thanks and have a great day, Perri The closure report to TCEQ was developed for commercial/industrial land use, and the site is suitable for that file://C:\Documents and Settings\radloo\Local Settings\Temp\XPgrpwise\4E98061ACity_...4/18/2012 Page 3 of 4 land use without restriction.  The soils can be disturbed and construction work completed without any oversight from TCEQ.  As stated in the TCEQ Closure Letter dated 4-13-11, future construction activities will disturb soils that may contain low levels of contamination, and these can be handled and moved around on the site.  If excess soils are to be removed from the site, they must be managed properly, as you would on any construction site, to be sure they are acceptable for their destination. If the City elects to get a second opinion, this question is probably not necessary, but I expected to see something in here about the impact this condition has on the development of the property. Beyond all of the lab work, did W&M ever address what can or can't be done on the property? If the City doesn't have anything from W&M, our questions would be (1) can we disturb the plume area without an issue with TCEQ since the soil is not contaminated and (2) what exactly must be done if we do foundation excavations in the plume area? 2. I also received the Final Assessment Report Form submitted to TCEQ from Rhonda yesterday.
