Marshall, P.E., Civil Engineer DATE: April 10, 2012 REF: PUBLIC HEARING: Consider updates for Land Use Assumptions, Capital Improvements Plans and the imposition of Impact Fees for Water, Waste Water and Roadway, in accordance with Chapter 395 of the Local Government Code. The assessment of impact fees is governed by Chapter 395 of the Local Government Code (LGC). This Code requires cities imposing impact fees to review their plan every 5 years and either determine no change is needed, or perform an update to the Land Use Assumptions, Capital Improvements Plan and the imposition of impact fees. On April 26, 2011 the City of Coppell entered into a contract with Freese and Nichols, Inc. to perform an Impact Fee Study for revisions to the City's current Capital Improvements Plan, and to make recommendations on the Impact Fees needed to implement the Capital Improvement Plan. This study was performed due to the recently updated `2030 Comprehensive Land Use Plan'. The impact fee process is as follows: • Develop updated Land Use Assumptions (LUA) • Perform capacity analysis to develop Capital Improvements Plan (CIP) • Conduct Impact Fee analysis and calculations • Present LUA, CIP, and Impact Fees to Capital Im j rovements A visory Committee (CIAO) ' � �+�t M' a-,, a web Z. 3G r .0 c S • Public Hearing at City Council meeting v u , e 4 3 f i • City Council approval / 3 � T o ,• Update Fee Ordinance M fit'? /a,00 The report generated by Freese and Nichols, Inc. looks at current and proposed Land Use Assumptions then analyzes the network and identifies potential deficiencies. The Water Impact Fee CIP identifies one water line deficiency: water line from the water tower on Southwestern Blvd. to the west and then south along Freeport to the intersection with Airline Drive. There were no deficiencies noted in the existing Wastewater system. The Roadway Impact Fee CIP identifies two roadway deficiencies: Sandy Lake Road from Denton Tap to N. Coppell Road and Freeport from Ruby Road to SH 121. On February 16, 2012, the Planning and Zoning Commission, acting as the Capital Improvements Advisory Committee (CIAC), met to review the information and recommended approval to City Council of the Roadway Capital Improvement Plan, the Land Use assumptions, and the Water and Waste Water Capital Improvement Plan. They also recommended that the Roadway Impact Fee remain at $150 per service unit and the Water and Wastewater Impact Fees remain at $900 per service unit. These recommended values are similar to the calculated maximum fees proposed in the study (Water - $995, Wastewater - $927, and Roadway - $210 per service unit). This item is to hold a public hearing on the subject matter. Staff will be present at the meeting to make a presentation and answer any questions. Discussion concerning a recommendation to City Council on the Land Use Assumptions; Water and Waste Water Capital Improvement Plans; Roadway Capital Improvement Plan; the associated Impact Fee and the proposed Water and Waste Water Impact Fees. STAFF REP.: George Marshall Director of Planning, Gary Sieb introduced Civil Engineer, George Marshall from City of Coppell /Engineering Department. Mr. Marshall then made his presentation to the Commission with exhibits on Land Use Assumptions; Water and Waste Water Capital Improvement Plans; Roadway Capital Improvement Plan; the associated Impact Fee and the proposed Water and Waste Water Impact Fees. He addressed questions from staff and the Commission. STAFF REP.: George Marshall After much discussion, Commissioner Sangerhausen made a motion to recommend approval to City Council concerning the Roadway Capital Improvement Plan and to maintain the Roadway Impact fees assessed at the currently collected $150 per service unit. Commissioner Kittrell seconded; motion carried (5 -1), with Commissioners Goodale, Frnka, Sangerhausen, Duncan and Kittrell voting in favor. Commissioner Pritzlaff voted in opposition. 4. Consider approval of making a recommendation to City Council concerning Land Use Assumptions, Water and Waste Water Capital Improvement Plans and the proposed Water and Waste Water Impact Fees. STAFF REP.: George Marshall Ken Griffin, City of Coppell/Director of Engineering & Public Works, Coppell, Texas, addressed questions from the Commission's concerns about General Bonds, Revenue Bonds usage for city projects, drought periods, LRT and city project construction costs. Commissioner Goodale made a motion to recommend approval to City Council concerning the Land Use Assumptions, Water and Waste Water Capital Improvement Plans and the proposed Water and Waste Water Impact Fees assessed at the currently collected $900 per service unit. Commissioner Sangerhausen seconded; motion carried (5 -1), with Commissioners Goodale, Frnka, Sangerhausen, Duncan and Kittrell voting in favor. Commissioner Pritzlaff voted in opposition.
