RE Wynnpage Lot 1 Block B Page 1 From: Andrea Roy To: Jim Witt Date: 3/28/03 12:31:38 PM Subject: Fwd: RE: Wynnpage Lot 1, Block B Jim: I believe I briefly mentioned to you that the Wynnpage HOA was upset that the developer building the office buildings in front of the subdivision had cut electricity and water to the Wynnpage median, thus killing the landscaping. So, the City has been doing all it can to assist the HOA in getting this matter resolved, but as Mr. Starkweather mentioned, the Planning & Engineering Departments have only known about this issue for 2 weeks (while this has been going on for 10 months). Rick O'Dell, Teresa Turner, and I have dedicated much time to this issue, but yet still can't satisfy the needs of Mr. Starkweather. He wants results now! I believe Teresa had even asked Ken if we could hold up Mark Wainscott's Pre-Con meeting on this upcoming project until this issue is resolved and he said we don't have the right to do that. Yes, we have asked Mark Wainscott for a letter of commitment on these issues and although our right to require this is going a little far, I do believe it will be provided to us and this can be corrected with the groundwork done on this next project. We have not required a FIRM DEADLINE, as requested by Mr. Starkweather, because we don't feel we have the right to, as this really seems to be a private matter and is related to a prior project, not the current one. The only problem with simply saying "it's a private matter between the HOA and Wainscott" is that the median is in the City Right-of-Way, blurring our role a little bit. The issue regarding Wainscott Builders " removing the landscape and irrigation maintenance liability from the Wynnpage HOA completely" is a"completely" private issue and an agreement between the two.
