Dear Mr. Davis & Mr. Witt:
Please find the enclosed letter from Houston L. Cavin, Project Manager for Architectural
Utilities, Inc.
I have some problems with Mr. Cavin's letter. First of all, I disagree that Architectural
Utilities has done their "best" to cooperate with the Lone Star in solving the problem of
our damaged parking lot. I feel that Architectural Utilities made several unsatisfactory
attempts at repairing the parking lot. On each occasion, AU has asked if I felt the work
was satisfactory and I responded to the contrary. What I think is that AU did their best
to fix the parking lot with as little expense as possible, rather than correcting thier
problem in a timely and professional matter.
Secondly, I disagree that AU offered to "provide the labor and equipment to spread rock
or base material over an area to improve the surface in question, if you will provide the
material." Mr. Davis, if you will remember, after discussing the problem areas in the
parking lot, I, as a goodwill gesture, offered to tee and call my gravel contacts with no
guarantee of success. Frankly, I do not feel that this was something I had to do and am
offended that my gesture has been construed in this manner.
Thirdly, Mr. Cavin states that "we do not believe that our construction necessarily
caused the problem." Previously, he had stated that "We have done our best to cooperate
with you in returning your property to its original condition." Obviously, if the parking
lot is not now in its original condition and contains areas that present potential liabilities
and the only area which is affected in the fourteen acre parking lot is the area where the
construction was done, the construction is the only factor which caused the problem. I
have personally worked on this parking lot for three years and I promise you that the
area in question permitted the parking of cars in wet and dry conditions previous to
March 1995.
Mr. Davis, when you asked me ifI would like to deal directly with Doyle
Huddleston/AU, I agreed that this might be in order rather than involving you if all we
needed to do was coordinate the repair work. However, I would like to know if you and
the City of Coppell agree with the position that Architectural Utilities has taken on this
issue. In speaking with John Robinson, we both feel that this situation has become
inexcusable given the "good faith" settlement agreement which caused the water line to
be run to 1849 Beltline Road in the first place.

As previously discussed, we have already purchased Flexbase for the repair of the
parking lot, which will be spread tomorrow by a contractor which I have coordinated.
An invoice will be sent to the City of Coppell for the work which is done to repair the
parking lot. I will no longer deal with Architectural Utilities or their agents until this
problem is resolved. Then and only then will I be willing to sign any document to
effectively "end the matter."

Dear Mr. Scaff:
We have done our best to cooperate with you in returning your
property to its original condition. We have now offered to provide
the labor and equipment to spread rock or base material over an
area to improye the surface in question, if you will provide the
material.
We agree to assist you in this, although we do not believe that our
construction activities necessarily caused the problem.
The purpose of this letter is to assure you that we will
participate as offered; however, we intend this to be the end of
the.matter.
Your acceptance of our assistance as offered will release us from
any further complaints or obligations regarding your property.
If you cannot agree to this, then we cannot agree to perform the
work. I must have this letter signed by you and returned to me
before we return to do this work.
