Please be advised that on behalf of the City of Coppell we have reviiewed the jift
F=Ius B2WMMjMW Easement for property owned by the Denton County Levee I i vi Wall
No. I (W.D.).
In reviewing this instrument, we are concerned about the non - exclusive nature of the
easement. It is the City's position with regard to taking an easement for the purposes of
providing a walking and bike trail and amenities relative thereto, that the Cmmtor would have the
right and retain the right to implement other easements which would interfere reasonably or
unseasonably with the use and maintenance of the City. We would by immutable to changing
paragraph 2 to read as follows:
"The easement rights and privileges granted herein are exclusive except
that the Grantor rosaves and r+eftias the right to use the GuemeW tt= for
all purposes which do not unreasonably interfere with the rights granted
h ere i n . "
With this minor change, we would be more comfortable with taking posson and
spending tax money to make these improvements and ensure that there is no urlrptaoiwtble
iatarf�+eoce.
