Dear Sir: I understand you had a conversation with Terry Holmes this week whereby you mentioned to him a few discrepancies noted in the data accompanying the CLOMR application. I wanted to hasten to clarify any misunderstandings so that the project can proceed. Please let me address several comments relayed by Mr. Holmes: • Appendix G can only be compared to Appendix C with respect to the single line labeled "Old Denton Creek, Cross Section A" as this is the only section in common (nearly) when comparing the two tables, approximately corresponding to River Station 238+00 of the subject study. I calculated WS Elev = 452.55 at this station and the LOMR shows the water elevation to be 453 ft. just upstream of Section A, so the two documents are nominally in agreement. • Specifically, Cross Section C of Denton Creek in Appendix C is designated Station (Distance) 25,520 but this cannot be compared to Station 255+30 along Old Denton Creek since there is a different flow rate, Manning's coefficient, etc. • The river cross-sections are all meant to be perpendicular to the flow along Old Denton Creek while the intent of Station 236+00 was to be along and parallel to the small tributary flowing from the project site. If you would, please consider the lines to be drawn schematically on the plan. • Please consider the CLOMR as a request to redraw the flood plain limits at the limit of fill or the headwall as shown in the construction plans, attached. The legal description of the remaining flood plain area on the development is attached. • I'm not sure which numbers from Appendix G are contradiction with the output report (Appendix I) so I've recreated the latter and attached it herewith. • Attached please find a copy of Appendix H for inclusion into the application and report. • Regarding permits required by Section 404 of the Clean Waters Act, it was our understanding that the area being filled has not been defined as navigable waters of the U.S. or a tributary thereof, or as adjacent wetlands. It is certainly not a `special aquatic site' as defined under 40 CFR 230.40. Even if the low area being filled was classified as wetlands, the work could be permitted under nationwide permit (NWP) No. 39 and the developer need only notify the District Engineer prior to initiating the work by submitting a preconstruction notification. However, since the area being filled is more than one-tenth (1/101h) of an acre but less than one-half(%) acre, preconstruction notification and approval is not required; it's only necessary to submit a report within 30 days of completion of the work. Since the effect on the flood plain is inconsequential and no environmental effects are evident, please expedite this review and approval. Sincerely, 9> ;,- ›d J. David Evans, P.E.
