Box 478 Coppell, Texas 75019-0478 IN REPLY REFER TO: Case No.: 96-06-102C Community: City of Coppell, Texas Community No.: 480170 Map Panel Affected: 0010 E T-218-65-CR Dear Mayor Morton: This is in response to a letter from Mr. Rusty Spiars, P.E., Spiars & DeOtte, Inc., requesting that the Federal Emergency Management Agency (FEMA) determine whether the following property is located in a Special Flood Hazard Area (SFHA), an area that would be inundated by a flood having a 1-percent chance of being equaled or exceeded in any given year (base flood). This property will be elevated by the placement of f'dl after the date of the earliest National Flood Insurance Program (NFIP) map showing the area in the SFHA. property_ Description: Proposed Tracts A and B, Estates of Cambridge Manor, Phase H Communi_ty and State: City of Coppell, Texas The legal descriptions of the parCels mentioned above are as follows: Proposed Tract A: BEGINNING at the southwest comer of Lot 9, Block C, Estates of Cambridge Manor, on the north line of Castle Creek Drive; thence S 89°08'02" E, 126.60 feet; thence S 66°42'02" E, 128.16 feet; thence S O1 °22'22" E, 570.28 feet; thence west, 25.00 feet; thence N 15°42'35" W, 320.00 feet; thence N 64037'05" W, 163.35 feet; thence N 03°12'19" E, 203.80 feet; thence west, 10.00 feet; thence N 00°22'46" E, 50.00 feet to the POINT OF BEGINNING. Proposed Tract B: BEGINNING at a half-inch iron rod on the north line of Deforest Road at the southwest comer of Lot 1, Nettie Long Addition; thence N 00°20'26" E, 7.00 feet to the POINT OF BEGINNING; thence N 00°20'26" E, 169.00 feet; thence S 89°41'49" W, 277.42 feet; thence S 00°05'38" W, 169.00 feet; thence N 89°41'49" E, 278.15 feet to the POINT OF BEGINNING. All fees necessary to process this Conditional Letter of Map Revision (CLOMR) were received with Case No. 96-06-053C. This letter revises the determination made in the CLOMR dated January 10, 1996. 2 On January 11, 1996, we received additional information necessary to process this request. After comparing this new information to the NFIP map for the City of Coppell, Texas, we determined that Tracts A and B described above would not be located in the SFHA if fill is placed as proposed. This conditional determination is based on the site plan, entitled "Grading and Erosion Control Plan, Estates of Cambridge Manor, Phase II, Coppell, Texas,' prepared by Spiars & DeOtte, Inc., dated January 10, 1996. Our final determination will be made upon receipt of a copy of this letter, a copy of the final plat with recordation data, and certified as-built information showing the elevations of the lowest ground on each tract. In addition, the enclosed form, entitled "Certification of Fill Placement," must be returned, signed and dated by a registered professional engineer, an accredited soils engineer, or the community's NFIP permit official. Portions of Parcels A and B mentioned above would meet the minimum requirements for the removal of the SFHA designation from a vacant parcel of land under Paragraph 65.5(a)(3) of the NFIP regulations. Because this request included no proposed elevation data for planned structures, the SFHA designation would not be removed from any planned structures. The request also did not present data about additional grading of the parcel, and therefore raises concerns with the elevations for the completed parcel. For any structure built in an area elevated by fill after the date of the earliest NFIP map showing the area in the SFHA, Paragraph 65.5(a)(4) of the NFIP regulations requires that both the lowest adjacent grade (lowest ground touching the structure) and the lowest floor (including basement) be at or above the base flood elevation. FEMA will determine if the existing or planned structure is located outside the SFHA upon receipt of all necessary elevation data for the structure. Please note that the NFIP is non-taxpayer funded and its expenses are paid by policyholders. Therefore, to minimize the financial burden on the policyholders while maintaining the NFIP as self-sustaining, FEMA has implemented a procedure to recover costs associated with reviewing and processing requests for modifications to published flood information and maps. Therefore, an initial fee of $225, which represents thc minimum charges associated with a request of this type, must be submitted before we can process your revision request. Payment of this fee shall be made in the form of a check or money order in U.S. funds made payable to the National Flood Insurance Program, or by credit card payment. Box 3173 MERRIFIELD VA 22116-3173 Please note that this property could be inundated by a flood greater than the base flood or by local flooding conditions not shown on the NFIP map. Flood insurance is available at a reduced cost for properties located outside the SFHA. Also, although we have based our determination on the flood data presently available, flood conditions may change or new information may be generated that could supersede this determination. This response is based on the minimum criteria established by the NFIP. State and community officials, based on knowledge of local conditions and in the interest of public safety, may set higher standards for construction in the floodplain. If the State of Texas or your community has adopted more restrictive and comprehensive floodplain management criteria, those criteria take precedence over the minimum Federal criteria. This letter does not relieve Federal agencies of the need to comply with Executive Order 11988 on Floodplain Management in carrying out their responsibilities and providing federally undertaken, financed, or assisted construction and improvements, or in their regulating or licensing activities.
