Splats & DeOtte Consulting Engineers 4230 LRI Freeway, Suite 215 Dallas, Texas 75244 Dear Mr. Spiars: This is in reference to your corr~pondence of August 8, 1995, requesting a U.S. Army Corps of Engineers (USACE) jurisdictional determination for portions of three tracts associated with the ~tates of Cambridge Manor, Phase H located along the right overbank of Denton Creek in the city of Coppell in Denton County, Texas. This project has been assigned Project Number 199500564. Please include this number in ali future correspondence concerning this project. Failure to reference the project number may result in a delay. We have reviewed the sites in question in accordance with Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899. Under Section 404, the U.S Army Corps of Engineers regulates the discharge of dredged and fill material waters of the United States, including wetlands. Our responsibility under Section 10 is to regulate any work in, or affecting, navigable waters of the United States. Based on your submittals, and other information available to us, we have determined that no waters of the United States or navigable waters of the United States exist on these sites. We have shown the boundary of the areas that we evaluated for this determination on the enclosed map. Department of the Army authorization under the above laws would not be required for activities in the evaluated areas. This jurisdictional determination is valid for a period of no more than five years from the date of this leRer unless new information warrants revision of the delineation before the expiration date. It is incumbent upon the applicant to remain informed of changes in the Department of the Army regulations.
