Dear Russell:
Thank you for meeting with me recently to discuss an application
for a sanitary landfill that is scheduled for a public hearing
before the Carrollton Planning and Zoning Commission on January 19,
1989. As you know, the proposed use will be located in the
Carrollton corporate limits, but the access to the proposed use
will be located within the city of Coppell.
For your convenience, I have summarized the concerns that were
expressed by your Development Review Committee at our meeting. I
will be presenting these comments to the Planning and Zoning
Commission on January 19, so please feel free to make any additions
to this list.
1) The portion of Sandy Lake Road that is within the city of
Coppell is not a designated truck route, and improvements to
the road are not funded at this time. Your estimate of the
time frame for improvement of the road is approximately 10
years. Although specific tests have not been conducted, you
feel the road was not built to accept the truck loads that
will result from this use.
2) The entrance to the facility is adjacent to the area of
Coppell that is expected to grow in the future. To the east
of the Texas Utility power lines is office and retail zoning.
South of the retail district on Sandy Lake Road is a 17 acre
single family zoning district that is expected to contain an
18 hole golf course. Residential districts are also located
west of the power lines. Your Development Review Committee
believes the proposed use will negatively impact the future
development of these areas.

3) Your co~ittee also expressed an interest in requiring the
applicant to receive approval of driveway locations and curb
cu~s from the city of Coppell at a public hearing before the
City Council prior to their occupancy of the property. As an
alternative, our office would prefer to list the standard
approvals that must be obtained from the city of Coppell in
an ordinance pe~itting the sanitary landfill use.
4) Safety issues are also a concern of your co~ittee. The
portion of Sandy Lake Road where the access is proposed is
located on a cu~e, and the size and nu~er of trucks on the
road may cause a hazardous situation.

Dear Ms. Stivers:
On July 8, 1988 Texas Industries, Inc. (as Lessee)
entered into a Lease Agreement with Ashlar Contracting
Company as Lessor for the entire 230.378 acres referenced
above and said Lease Agreement was approved of and consented
to by Northwest Dallas County Flood Control District as a
partial owner of Materials in, on and under the Property.
Materials as defined in the Lease Agreement are all non-
metallic minerals (except oil and gas and other hydrocarbon
products) and all construction materials including but not
limited to sand, gravel, sand clay gravel, sand and gravel
mixed, fill sand, flume sand and/or overburden. Said Lease
Agreement grants to Texas Industries, Inc. the exclusive
right to sample, drill and test for, develop, mine, quarry,
extract, process, sell and remove Materials during the term
of the Lease Agreement. A Memorandum Of Lease was signed on
September 26, 1988 and recorded on October 4, 1988 in the
Real Property Records.
Furthermore, during July, 1988 and prior to August 18,
1988, Texas Industries, Inc. mined, sold and removed
Materials from said 230.378 acres pursuant to SUP-62 granted
to Northwest Dallas County Flood Control District and Ashlar
Contracting Company.
Since the access agreement from the 230.378 acres to
Sandy Lake Road would have expired as of September 30, 1988,
Texas Industries, Inc. had planned to ask for an extension
of SUP-62 with modifications or reapply for a similar type
of Special Use Permit for Mining Purposes upon Ashlar
Contracting Company's completion of a new Right-of-Way
Agreement with Texas Utilities Electric Company, Dallas
Power and Light Division for access to Sandy Lake Road. An
access agreement has been formulated and verbally agreed to
by the parties noted, but said access agreement remains
unsigned by both parties awaiting the acceptance of certain
performance bonds.

Consequently, Texas Industries, Inc. objects to and
requests a denial or postponement of 01-89 SUP4 and 01-89 Z3
by the City of Carroliton Planning And zoning Commission and
subsequent thereto the Carrollton City Council unless the
following items are taken into account, accepted and made a
part thereof in any zoning change or special use permit
affecting the 230.378 acres approved by the Planning And
Zoning Commission and subsequently so ordered by the
Carrollton City Council as follows:
1. Texas Industries, Inc., its successors and/or assigns
along with the current and/or future owners of the fee
title of the property shall be granted a separate
Special Use Permit for a one (1) year period to provide
for sand, gravel and earth excavation located upon the
230.378 acres being the same property that ordinance No.
1406 SUP-62 previously applied to and upon which 01-89
SUP4 and 01-89 Z3 have been applied for. Texas
Industries, Inc. would have no objection to the addition
of Exhibit "C" from SUP-62 with the Dallas Gun Club and
Texas Industries, Inc. being the involved parties.
2. Sand and gravel deposits are a valuable natural resource
when mined, removed and utilized as a construction
material in roads and buildings, etc. and such mining
and utilization generates jobs and spurs business acti-
vities in the communities in which they occur and serve.
Also sand and gravel type deposits often act as aquifers
and therefore may interact hydrologically with surface
and subsurface ground water and surface stream flow.
Consequently, exposed sand and gravel deposits need to
be removed or sealed off to prevent contamination of
other properties and/or surface stream flow prior to a
property being utilized as a Type I Municipal solid
waste landfill. Needless to say, the continued removal
of existing exposed sand and gravel deposits upon the
230.378 acres is an appropriate and expedient means of
utilizing a valuable natural resource and preventing
contamination of water resources.
3. Since Type I Municipal Solid Waste Landfills as per-
mitted by the State of Texas in accordance with U.S. EPA
regulations require that a clay type (overburden)
sealant be placed upon the top of each level of solid
waste fill, then it becomes apparent that a landfill
operation involves the excavation, removal and sub-
sequent replacement of "Materials" as a normal part of
its business activity involving similar type
mining/construction equipment. Consequently the request
noted in item ~1 is not inconsistent with the granting

of 01-89 SUP4 and/or 01-89 Z3. However the mining and
removal of a sand and gravel type deposit (Materials) is
not regulated and does not require permits except for
air and water =-_mission standards and city/county zoning
regulations where applicable. Consequently item ~1
should be granted as a separate SUP but excavation,
removal and replacement of Materials would also be a
part of 01-89 SUP4.
Texas Industries, Inc. has discussed with Ashlar
Contracting Company and Huel H. Weaver, Jr. their intentions
regarding the filing of the applications for 01-89 SUP4 and
01-89 Z3. As stated to me personally, it is not the inten-
tion of either Ashlar Contracting Company or Huel H. Weaver,
Jr. to have 01-89 SUP4 and/or 01-89 Z3 interfer or prevent
Texas Industries, Inc. from obtaining either a separate
Special Use Permit to provide for sand, gravel and earth
excavation or from utilizing for mining purposes said 01-89
SUP4 permit and/or 01-89 Z3 zoning change if approved under
a planned Development District approach.
I am confident that the Planning And Zoning Commission
and the Carrollton City Council will place these comments
and requests of record and further understand the
seriousness of Texas Industries, Inc.'s interest in and to
the property and the City of Carrollton.

it is my understanding that :;eaver Construction Company is in-
terested in starting a landfill operation in the City of Carrollton.
The purpose of my letter is to advise you of my past experience with
,~eaver Construction Company and its owner Huel ;';eaver.
I have been familiar with ,~eaver Construction Company's activities
for over twenty-five years, and I can truthfully say that I do not
believe I know of a company with more intergrity or higher stand-
ards. ,Vhen I worked in the City of Dallas Public ]forks Department,
I had personal knowledge of how .feaver Construction Company con-
ducted its excavation, grading and pipe operations. I later trans-
ferred to the Sanitation Division of the City of Dallas and was in
charge of all landfill operations for a number of years'. During
that time, ~eaver Construction Company supplied heavy equipment and.
personnel to the City of Dallas on various landfills. I particularly
recall when I was trying to extend the life of the i~alnut Hill Land-
fill at Stemmons, .~eaver Construction Company furnished six 623B
Cat Elevating Scrapers for approximately three years. Also, when I
began the ;,~cCommas Bluff landfill which consolidated all of the City
of Dallas landfill operations, ,~eaver Construction Company furnished
some of the equipment for that initial start up and was a lot of help.
Over the years I have had many meetings with Huel Jeaver to discuss
matters involving equipment selection, construction deadlines,
engineering, flood control, excavation, daily cover, haul roads,
safety, highest and best use of equipment and personnel, equip-
ment maintenance and repairs, operator problems, extended hours of
operation and many other matters related to all aspects of a land-
fill operation. I sincerely believe Huel Weaver thoroughly under-
stands the landfill business and is quite knowledgeable about all
aspects of the business. I always found Huel Weaver to be an hon-
est and fair individual, and he was always available and genuinely
interested in everything involving our operations.
After my retirement with the City of Dallas, I accepted a position
with the City of ?4esquite to manage their landfill operations. It
is my understanding that ~';eaver Construction Company has worked very
satisfactorily with the City of ~lesquite over the years on a similar
basis as they did ~ith the City of Dallas, only on a smaller scale.

On August 18, 1987, the City Council approved an extension

Excavation for a period of one year. The ordinance
granting the time extension required the owner to pave the
haul road for a distance of 100 feet in each direction of
Sandy Lake Road, and required the property to be graded in
accordance with a grading plan at the time the Special Use
Permit expired. The right to excavate sand, gravel and
earth on the property expired on August 18, 1988.

potential sports complex. It has been designated as Tract III
in the Five Year Master Plan for the City Bond Program,
although funds were not appgoved for purchase.
3. Providing Tract III (Lively Tract) is ever made available to
the city, a landfill will be adjacent to the future sports
facility, and those adverse conditions associated with a
landfill will have to be dealt with.

Sandy Lake Road be paved in order to avoid the tracking of mud
onto Sandy Lake Road within the city of Carrollton.
4. The developer shall contact the city of Coppell since the site
will access Sandy Lake Road within the city of Coppell in
order to comply with all appropriate regulations within
Coppell.
5. The State Department of Highways and Public Transportation
inspected the bridge on Sandy Lake at the Elm Fork of the

analysis of the proposed weights of the trucks in relationship
to the existing pavement design of Sandy Lake in order that no
extensive damage will occur to the roadway from utilizing
Sandy Lake Road. Sandy Lake Road is NOT in the present
Capital Improvement Program to be rebuilt during the next
several years.

was approved for the request site for a period of two years
on August 15, 1985. The Special Use Permit was approved
subject to several conditions including approval of a
performance bond guaranteeing reclamation at the end of the
two year period.
On August 18, 1987, the City Council approved an extension
of the Special Use Permit for Sand, Gravel and Earth
Excavation for a period of one year. The ordinance
granting the time extension required the owner to pave the
haul road for a distance of 100 feet in each direction of
Sandy Lake Road, and required the property to be graded in
accordance with a grading plan at the time the Special Use
Permit expired. The right to excavate sand, gravel and
earth on the property expired on August'lS, 1988.

1. Staff is recommending a worksession to allow the Planning and
Zoning Commission and the City Council to jointly assess the
technical elements of the case and the appropriate land uses
for the area. Several issues associated with this use have
been identified as areas that need to be discussed during the
worksession:
A. Access to and from the property is proposed along Sandy
Lake Road within the city of Coppell. Most of the
properties within the city of Coppell with frontage along
Sandy Lake Road east of the Texas Utility right-of-way are
zoned for office and retail uses. West of the utility
right-of-way the properties with frontage on Sandy Lake
Road are zoned for residential uses. Since the entrance to
the landfill is adjacent to areas where Coppell is expected
to grow in the future, an assessment of the impact on the
area should be considered.
B. The Carrollton Transportation Department and the city of
Coppell are concerned about the amount and weight of truck

traffic that will be generated by the use. Additional
information must be obtained to determine whether the
present road can accept the truck loads that will result
from the use. Improvements to Sandy Lake Road are not
funded by the city of Coppell or the city of Carrollton at
this time. The earliest date the city of Carrollton can
fund improvements to the road is 1992. The city of Coppell
has estimated that improvements to their portion of Sandy
Lake Road will occur within the next 10 years. The impacts
of the additional truck loads on the life of the road must
also be considered.
C. The applicant proposes a Type I sanitary landfill that will
accept both public and private contracts. A Type I
landfill is not allowed to accept any toxic or hazardous
wastes. A permit to operate a Type I landfill must be
obtained from the State Department of Health, and
enforcement of the State standards will be the
responsibility of the Department of Health. However, the
city's Environmental Health division will still be required
to investigate complaints associated with the use. This
added responsibility for enforcement may have a fiscal
impact on the Environmental Health Department. (See memo
from Environmental Health dated January 12, 1989.)
D. The city is currently participating in a Regional Solid
Waste Management Plan that is being conducted by the North
Central Texas Council of Governments. The advisability of
approving this use prior to the adoption of the plan should
be considered by the city. (See memo from Public Works
dated January 3, 1989.)
E. The Parks Department has a concern about the impact of the
proposed landfill use on an adjacent tract that has been
designated as public recreation area in the Five Year
Master Plan for the City Bond Program. Funds to purchase
the adjacent tract have not been approved, but the impacts
of the proposed sanitary landfill on any future parklands
need to be assessed.
F. The area between I35 and the future State Highway 190
connector freeway is primarily an area of industrial uses.
~a~ea-~ The area to the west of the future Highway 190
connector is zoned for residential uses with Special Use
Permits for the existing mining use and the Gun Club. The
impacts of the proposed use on the future land uses in the
area should be addressed.
G. A new sanitary landfill use may need to be located within
the city's corporate boundaries sometime in the future in
order to meet the solid waste needs of the community. The

city needs to determine what type of characteristics would
make an acceptable site for the use, and what areas of tP

A. A 404 Wetlands permit must be obtained from the Corps of
Engineers.
B. A FEMA (Federal Emergency Management Administration) permit
must be obtained from the Corps of Engineers.
C. A permit must be obtained from the Texas Water Commission.
D. A permit to operate the facility must also be obtained from
the Texas Department of Health. Due to anticipated changes
to state and federal laws regulating sanitary landfills,
additional state and federal permits and/or approvals may
need to be obtained before the use may begin operation.
E. Construction drawings of the driveway and drive cut need to
be submitted to the city of Coppell.

b. Specific technical concerns with this submittal are as follows:
1. The city of Carrollton has designated truck routes. Sandy
Lake Road is not a designated truck route within the city of
Carrollton. All trucks will be required to comply as per the
Ordinance.
2. The city of Carrollton governs the maximum weights of vehicles
on city streets. The developer of Sandy Lake disposal
facility shall comply with this section of the Traffic Chapter
within the Code of Ordinances.
3. The city of Carrollton Transportation Department recommends
that a thousand foot minimum of the access roadway adjacent to
Sandy Lake Road be paved in order to avoid the tracking of mud
onto Sandy Lake Road within the city of Carrollton.
4. The developer shall contact the city of Coppell since the site
will access Sandy Lake Road within the city of Coppell in
order to comply with all appropriate regulations within
Coppell.
5. The State Department of Highways and Public Transportation
inspected the bridge on Sandy Lake at the Elm Fork of the
Trinity River on December 21, 1987. The bridge currently is
recommended to be posted a 24,000 lb. maximum gross weight and
12,500 lb. maximum axle weight. The trucks proposed to travel
over this bridge to reach the landfill shall comply with this
regulation.
6. The developer of the landfill is recommended to submit
analysis of the proposed weights of the trucks in relationship
to the existing pavement design of Sandy Lake in order that no
extensive damage will occur to the roadway from utilizing
Sandy Lake Road. Sandy Lake Road is NOT in the present
Capital Improvement Program to be rebuilt during the next
several years.

1. All recommended changes (by the Planning and Zoning Commission)
must be made by the applicant prior to presentation to the City
Council.
2. The following (6) copies of the corrected Special Use Permit site
plan are required after Planning and Zoning approval:
a. (1) 24"X36" mylar
b. (3) 24"X36" blue lines (with one blue line to be attached to the
building permit application by the applicant.
c. (2) Photographical Mechanical Transfers (Matte positive of a
P.M.T. or "stat") are required.
3. No building permits will be issued prior to the Building Official's
receiving written notice from the Planning Department that a plat
has either been filed previously or recently been mailed to the
County to be filed of record.

The City of Carrollton has entered into an agreement with The
NorTh CenTral Texas Council of Governments and has provided
funding for the Regional Solid Waste Management Plan. Program
objectives include.
o respond to the current local government solid waste needs
and concerns
o meet the short and long range solid waste planning
requirements of she Texas Department of Health
o redirect local priorities to match those mandated by the
Texas legislature toward waste minimization reuse and
recycling. ' '
This plan will undergo formal local government and public review,
adoption by ~he NCTCOG Executive Board, and final submittal To
the Sta~e Board of Health for adoption. The ~ime schedule for
adoption by NCTCOG is mid-1990.
To support a zoning change to allow the development of a landfill
on this trac~ aT this time would be premature aT best. Please
express my concerns to ~he Planning and Zoning Commission.

REGARDING: Case #01-89Z3
The operation of a commercial landfill within the city limits of
Carrollton will have significant impact on the workload of this
department. As a regulatory agency this department will have to
allocate manpower for enforcement and oversight. Any complaints
associated with the operation of the landfill w~ll have to be
handled through this department.
We anticipate the following issues will be associated with the
opera:ion of any landfill which we will have to address throughout
the life of the facility and after its' c±osure.
1. The proper disposal of trash that would fall off trucks going
to and from the landfill.
2. The monitoring of surface and subsurface water for
con=amlna=ion in and around the landfill.
3. The control of rodents, birds and wildlife that may be
attracted by the operation of the landfill.
The control of odor, noise, dust and flying debris due to
high winds.
This is not in any way a reflection of the future operators or
owners of this or any other landfill, but a statement of issues
and problems that will have to be addressed with the opera,ion of
any landfill wiDhin the city liml~s of Carrollton.

SUBJECT: FY89 Funding for Regional So]id Waste Management Planning Program
We are well underway in the two-year planning program designed to produce a
Regional Solid Waste Management Plan in mid-1990. There are six Regional Task
Forces studying the key issues raised by member local governments, including:
residential and commercial waste, institutional and technology issues,
recycling/reuse opportunities, and illegal dumping. The results to date will
be discussed at a free day-long workshop at our offices on October 27th.
The state regulations also authorize and encourage local governments to develop
more-detailed local so]id waste management plans, which are to be compatible
with the regional plan. State law requires cities and counties to assure by
December 1989 that "adequate service" is being provided to all citizens.
NCTCOG will assist its members to address these state requirements.
At the June 1988 CMAC meeting, I outlined the regional planning work program
and anticipated funding. NCTCOG funds completely supported the FY88 start-up
activities. A combination of NCTCOG funds and special contributions from
member governments is anticipated for FY89.
To obtain pro-rata local funding, I am recommending that NCTCOG execute the
attacheo Letter of Agreaaent with each of its 20 largest cities. These
cities have about 75% of the region's population and over 80% of its
employment, and thus most of its so]id waste. Through its committee and staff
activities, NCTCOG would provide many "products" of direct benefit to these
cities, as detailed in the Letter of Agreement under the following categories:
1. Successful continuation of local cooperation through public education and a
communications network.
2. Assessment of solid waste management facilities and practices in region to
meet December 1989 state requirement on cities and counties.
3. Computerized geographic mapping and information system.
4. A "Regional Po]icy Position on Solid Waste Management" to be adopted by
NCTCOG's Executive Board and submitted to member governments for action.
5. Identification and initial evaluation of joint actions beyond local plans.
6. Encouragement and facilitation of local solid waste management plans.
