Patton, Burke & Thompson (PBT) is pleased to submit this written proposal, in accordance with our July
15, 1997 conversation with you, for performing certain geotechnical consulting services for the referenced pond.
This study will be in addition to the work previously performed in late-1995.
GENERAL
It is our understanding, based on the work reported for this site on November 2 and 30, 1995, that the
subject pond is privately owned by the Chaucer Estates homeowner's, is approximately 1 to 1-1/2 acres in plan,
was constructed in the last 5 or 6-years with a normal pool elevation of 460.0-feet and reportedly had an original
bottom elevation of450.0-feet. Apparently the pond has shown signs of continuing siltation, according to the
Homeowners. The primary purpose of this assignment is to provide geotechnical subsurface information to assist
the City in quantifying the extent and nature of the current siltation.
SCOPE OF WORK
Our proposed scope of work, again based upon discussion with you, our previous experience with this pond
and similar assignments, would involve a geotechnical engineering investigation program. The following describes
the general scope of work we propose at this time for carrying out the necessary, in our opinion, services:

1. Field investigation
· Four (4) shallow sampling probes taken in the pond area which penetrate the bottom silt layer
and a foot or so into the original pond bottom. These probes, estimated to penetrate 5 to 6-feet
of total soil sediments, will be taken from a 12 to 14-foot work boat and samples obtained by
either pushing or driving a soil sampler.
2. Laboratory Testing
· Moisture content, unit weight (if possible), and grain-size analysis on selected siltation soils to
determine classification and consistency properties.
· Other laboratory tests as deemed appropriate upon evaluating findings of probes.
3. Engineering Analyses/Written Report
· Pond bottom soil stratigraphy and associated variability, at sampled locations.
· Evaluation of physical and consistency characteristics of bottom soils.
· Discussion of findings and conclusions in regard to thickness and geotechnical properties of
siltation.
4. Assumptions Regarding Site and Field Work
· The probes will be located in the field by PBT based upon rough measurements from existing
features.
· Selected probe locations are flee of underground obstructions, and underground utilities, if any,
will be located by others.
· Field standby time (outside PBT's control) will not exceed 1-hour.
· The assignment assumes that only non-contaminated/non-hazardous soils and subsurface
conditions will be encountered during the field exploration program. Otherwise, the proposed
cost for the field and laboratory investigations will need to be revised.
PRICING/CONTRACTING
PBT proposes to perform the work for this investigation on a time and materials basis, for the scope of
work outlined above, for a maximum not to exceed budget of/$2,350.] Furthermore, we propose to provide all
services in accordance with PBT's General Terms & Conditions (Form 1-97A), and any additions or modifications
to the above referenced scope of work, with prior approval by you, will be in accordance with PBT's Schedule of
Charges (Form 9-97/B)

SCHEDULING OF WORK
PBT will develop a schedule for the field investigation program immediately upon your authorization. The
field program, barring any access problems or severe weather, can normally be completed in less than one (1)
working day at~er mobilization to the site and the laboratory testing program, for selected soil sediment samples -
retained from the probes, will be completed within two (2) or four (4) working days after field program completion.
Following the collection of all field investigation and laboratory testing data, preliminary verbal findings can
be presented, if desired, within one (1) to two (2) working days. The final written report will be submitted within
five (5) working days after the preliminary verbal findings.

General Terms and Conditions
1.0 General
Patton, Burke & Thompson (PBT) by the performance of services covered hereunder, does not in any way assume any of
those duties or responsibilities g~th regard to the project's design professionals or an), other design agencies or authorities.
Client agrees to furnish or cause to be furnished to PBT, all documents and information k~og~ to client that relate to the
identity..-, location, quantity, nature or characteristics of any hazardous or toxic materials on or near the site. In the event that
test samples obtained during PBT's work contain substances hazardous to health, safety, or the environment, these samples
remain in the property of the client.
2.0 Billing
PBT grill submit progress invoices to client monthly and a final invoice upon completion of services. Each invoice, on
presentation, is due and payable by client or his authorized representative. Pa)xneat is past due 30 days fi.om invoice date.
Client agrees to pay interest of one and one-half percent (1-1/2%) per month, (but not exceeding the maximum rate
allowable by lag'), on past due accounts. Any attorney's fees or other costs incurred in collecting any delinquent amount
shall be paid by client.
3.0 Standard of Care
PBT ser~dces will be perfomaed, v,~thin the limits prescribed by its clients, v,4th the usual thoroughness and competence of
the engineering consulting profession, and in accordance with the standard for professional services at the time and under
similar conditions those services are rendered. No other warranty or representation, either expressed or implied, is included
or intended in PBT's proposals, contracts, or reports.
4.0 Liability
PBT's liability shall be limited to injury or loss caused by the negligence of PBT, its subcontractors, and/or agents
hereunder. PBT has neither created nor contributed to the creation or existence of any hazardous, toxic, pollutant, or
otherwise dangerous substance or condition at the site, and its compensation hereunder is in no way commensurate with
the potential risk of injury or loss that may be caused by exposure to such substances or conditions.
PBT's liability for injury or loss arising bom (1) professional e~rors or omissions and/or (2) any hazardous, toxic, pollutant,
or waste gases, liquids, or solid materials shall not exceed $5,000 or our fee, whichever is greater.
PBT's liability for injury or loss arising from comprehensive general and automobile exposures shall not exceed $100,000.
The client agrees to defend, indemnify, and hold PBT harmless fi'om any claim, liability, or defense cost in excess of the
limits stated herein for injury or loss sustained by any party fi.om exposures allegedly caused by PBT's performance of
services hereunder.
In the event the client makes a claim against PBT, at law or otherwise, for any alleged error, omission or other act arising
out ofthe performance of its professional serv4ces, and to the extent the client fails to prove such claim, then the client shall
pay all costs, including attorney's fees, incurred by PBT in defending itself against the claim.
5.0 Applicable Law
All general terms and conditions shall be governed by the laws of the State of Texas.

measured by the following charge elements.

2.0 Equipment Charges
PBT equipment, if used, will be billed at the rates noted in the proposal.
3.0 Other Services and Supply Charges
Charges for services, equipment and facilities not furnished directly by PBT, and any unusual items of
expense not customarily incurred in PBT's normal operations, are computed as follows:
· Cost plus 15 percent includes surveying services, land drilling equipment, construction equipment,
testing laboratories, shipping charges, subsistence, transportation, outside printing and reproduction,
long distance communication, special supplies and rentals.
· Cost plus 20 percent includes aircraft:, watercraft, and marine drilling equipment.
