improvements. However, this permit should not be issued until the actual

Re: Chautauqua Place - Early Building Permit
Dear Gary:
Over the past few weeks I have been coordinating on the Harris Street
constru,~'tion schedule and plans with Ken Griffin. During one of those discussions
I inquired about the possibility of getting an early building permit for one of the
lots adjacent to the already improved section of Harris (see attached). The
purpose of this request is to enable completion of a model home about the same
time the subdivision is finished.
It is my understanding from Ken that the request for such a permit would
be approved, but would be subject to the following understanding:
(1) No certificate of occupancy would be granted until the subdivision
is complete and accepted by the City;
(2) The builder shall hold the City harmless for any delays in the
completion and acceptance of the subdivision.
This inquiry is for the benefit of Pacific American Homes, who will be
building on all of the lots in this subdivision. If the understanding I have described
above is consistent with yours, please acknowledge in the space provided below
and return a copy of this letter to me. I will then coordinate with Pacific
American about making the pe~it application at the appropriate time.

In reference to the above letter, please note that an early release of a building
permit for I_ot 1 Block B, Chautauqua Place will be granted under the provisions
of Section XV of the Subdivision Ordinance, entitled "Issuance of Building Permits,*
This section allows the City Engineer authority, after reviewing the progress of
construction and other relevant matters, to release portions of the subdivision for
building permits. Once the construction of the public improvements for Chautauqua
Place have begun, then the permit can be requested, Again, as you noted, no
Certificate of Occupancy will be granted for the referenced lot until all public
improvements have been installed and accepted by the City,
