AN 8" PVC WATER PIPELINE ACROSS THE
TRINITY RIVER AUTHORITY OF TEXAS' COPPELL INTERCEPTOR
THE STATE OF TEXAS
COUNTY OF DALLAS
THAT the TRINITY RIVER AUTHORITY OF TEXAS (AUTHORITY), a conservation and
reclamation district created by and functioning under Chapter 518, Acts of the
54th Legislature of the State of Texas, Regular Session, 1955, as amended
pursuant to Article XVI, Section 59 of the Texas Constitution, with its
principal office at 5300 South Collins, Arlington, Tarrant County, Texas
76018; for and in consideration of TEN AND NO/IO0 DOLLARS ($10.00) and other
good and valuable consideration to AUTHORITY in hand paid by CITY OF COPPELL,
TEXAS (LICENSEE), whose address is 255 E. Parkway Blvd., Coppell, Texas 75019
the receipt of which by AUTHORITY is hereby acknowledged, has given and does
by these presents give LICENSEE a permit subject to performance of the
obligations herein to enter upon and to construct, operate, maintain, inspect,
patrol, repair, replace and remove an 8" PVC water pipeline (facilities) with
all necessary appurtenances thereto, over, across, under and through that
certain land situated in Dallas County, Texas, as shown in Exhibits "A", "B"
and "C", attached hereto and made a part hereof. The attached exhibits shall
be incorporated into LICENSEE'S construction plans for said facilities.
LICENSEE will exercise extreme diligence while working in the area of
AUTHORITY pipeline(s) and/or property. In the event that AUTHORITY
pipeline(s) and/or property become damaged, fractured or broken, expeditious
repair will be coordinated with AUTHORITY on-site personnel immediately
thereafter, at LICENSEE'S sole cost.
LICENSEE agrees to convene a preconstruction meeting at least seventy-two (72)
hours prior to LICENSEE'S construction of said facilities. The
preconstruction meeting shall include, but shall not be limited to, the
appropriate AUTHORITY personnel, LICENSEE and LICENSEE'S engineer and
construction contractor. LICENSEE shall contact Robert J. Roth, AUTHORITY'S
Technical Services Engineer at 214-263-6078 in order to schedule the meeting.
AUTHORITY acknowledges that the consideration paid by LICENSEE is full and
final payment for all rights granted herein.
LICENSEE shall clean up and remove all trash and debris, repair and replace
fences and repair other damages caused by said construction, operation and
maintenance.
LICENSEE shall use due care and diligence in its conduct, activities and
operations upon the premises and shall assume the risks incident to or in
connection with the construction, installation, operation and maintenance of
the facilities. LICENSEE shall be responsible for all accidents or injuries
of whatsoever nature or kind to persons or property caused by its negligence.
Furthermore,-LICENSEE shall defend, hold harmless and indemnify AUTHORITY and
all of AUTHORITY'S officers, agents, employees and invitees at all times from
all losses, costs, expenses, damages or judgments on account of real or
asserted injuries to persons or property caused by the negligence of LICENSEE.
Approval by AUTHORITY of any drawings, designs, specifications, reports or
incidental engineering work shall not in any way relieve the LICENSEE of
responsibility for the accuracy and suitability of the work.
LICENSEE agrees to obtain and maintain any and all permits and licenses from
the State of Texas, the United States of America or any agency or
instrumentality thereof or from any other governmental authority necessary or
proper for the performance of LICENSEE hereunder. Furthermore, LICENSEE
agrees to comply with all laws, federal, state and municipal, of every type
and kind affecting the facilities.
LICENSEE agrees that its facilities shall be installed and maintained free of
defects. LICENSEE will operate and maintain said facilities in a reasonable
and prudent manner so as not to cause or let exist conditions which might pose
an unreasonable risk of damage or pollution to AUTHORITY or AUTHORITY'S
property.
Upon completion of construction and installation of the facilities and
subsequent initiation of operation and maintenance responsibilities, LICENSEE
will notify AUTHORITY of the date the installation was completed. If the
facilities are not installed within two years from the date hereof, this
permit shall terminate and all rights of LICENSEE granted herein shall be null
and void. Additionally, if LICENSEE ceases to use the facilities for twelve
(12) consecutive months, then all rights of LICENSEE hereunder shall terminate
and all rights of LICENSEE granted herein shall be null and void.
LICENSEE agrees that in the course of operation and maintenance of the
facilities, if it becomes necessary to replace or relocate the facilities,
AUTHORITY approval shall be required prior to said replacement or relocation
of the facilities.
LICENSEE, its successors and assigns, may fully use and enjoy said premises,
except that such use and enjoyment shall not hinder, conflict or interfere
with the exercise of AUTHORITY'S rights.
In the event that LICENSEE'S construction, operation and/or maintenance plans
conflict with the rules and regulations of either the Texas Department of
Health or with the Texas Natural Resource Conservation Commission, then said
rules and regulations shall be controlling.
LICENSEE agrees to provide the AUTHORITY with two (2) sets of I"AS-BUILT"
.construction plans complete with plan, profile and detail sheets, within 90
days after the construction has been completed and accepted by LICENSEE.
As depicted in Exhibits "B" and "C", LICENSEE shall construct, operate and
maintain said facilities with a minimum of 8 feet clearance above AUTHORITY'S
existing pipeline at AUTHORITY'S Station 111+40.
The rights and privileges herein granted shall be binding upon and inure to
the benefit of AUTHORITY and LICENSEE, respectively, and to their respective
successors and assigns. LICENSEE shall not assign its rights hereunder
without obtaining the prior written consent of AUTHORITY to such assignments.
It is expressly understood that all rights, conveyances or covenants are
herein written, and no verbal agreements of any kind shall be binding or
recognized or in any way modify this instrument. It is further understood and
agreed that this permit is offered and accepted without covenants or
warranties of any kind by AUTHORITY, either express or implied, including
warranty of title.

CLEARANCE - the number of feet between the proposed modification and the
Authority's facility. The clearance should indicate if the modifications are to the
above, below or next to the Authority's facilities,
TRA FACILITY - pertains to wastewater interceptors, water pipelines, meter
stations, lift stations, etc... TRA facility plans may be obtained from the appropri-
ate Project.
TRA STATION NUMBER - TRA station numbers can be obtained from the appropri
ate Project's as-built construction plans and must be included on the Permit Re-
quest Form.
