Dear Sirs,
On behalf of Childrens ~'orld Day Care Centers, we are
requesting consideration of the Final Plat for Lot # Block
I of Sandy Lake Plaza. The Preliminary Plat has been
approved.
The owners of the property have recently been made
aware of a different side and rear yard setback
interpretation than was inferred by the zoning ordinance to
all parties cluring the preliminary platting stage. The
owners previously 'were under the impression that a 10' side
and rear yard setback would be required but now are
informed that due to a recent interpretation the required
setback will be 30'.
If a 30' setback is required along the north property
line only a narrow building can be accommodated on the lot
which would be unacceptable for the uses originally
proposed by the owner and permitted by the zoning
ordinance.
It is the owners' opinion that the 30' setback
requirement is excessively restrictive due to the amount of
land area which would be required for a business of this
small size. This unusually large setback for such a small
lot would create such a hardship that it would make it
economically unfeasible. It is also the owners opinion
that it is not the City of Coppell~s intention to exclude
small businesses from the city. Due to these factors along
with the individual site conditions pertinent to this lot
including screening, surrounding land uses, and previous
approval of the preliminary plat with a setback indicated
for 10'~ we ask that a variance be granted to permit a 10'
setback along the side property lines.
