Latitude : 32° 58' 02.44" (NAD-83)
Longitude: 97° 01' 25.02"
Heights : 175 feet above ground level (AGL)
700 feet above mean sea level (AMSL)
Once the water storage tank has been built, it will require increasing the Minimum Descent
Altitude (MDA) of the LOCALIZER RUNWAY 17C STANDARD INSTRUMENT APPROACH
PROCEDURE from 920 feet AMSL to 960 feet AMSL. A pilot flying this approach may
descend no lower than the MDA unless he has visual sight of the runway in which case he
may continue and land.
The amendment to this approach will change the MDA [vertical movement of the aircraft] only.
It will not require changing the flight path [horizontal movement of the aircraft] of this
approach. This means that the amendment to this approach will be invisible to the residents
of Coppell.

Dear Mr. Beard:
We are in receipt of the Federal Aviation Administration, Acknowledgement of Notice of
Proposed Construction or Alteration, dated January 2, 1997, for the pending construction
of the City of Coppe!l's 2 million gallon elevated water storage tank (Aeronautical Study
No. 96-ASW-3281-OE). We understand this Acknowledgement supersedes the one dated
December 27, 1996.
The Acknowledgment indicates that an additional notification (FAA Form 7460-2) will be
required once actual construction of the elevated tank begins and again within five days
after the construction reaches its greatest height. We understand once those forms are
submitted, the FAA will make adjustments to the standard instrument approach at the
Dallas/Ft. Worth International Airport. It's our understanding that those adjustments will
involve vertical movement only, not horizontal. As flight patterns over the City of Coppell
are of a particular concern and interest to the residents of the City, please provide a
detailed written explanation of the changes that are anticipated by the FAA in the
instrument approach patterns at D/FW Airport as a result of this project.

Dear Mr. Griffin:
We have received a copy of the Federal Aviation Administration, Acknowledgment of Notice of Proposed
Construction or Alteration, dated January 2, 1997. This Acknowledgment supersedes the one previously
received by the City of Coppell and dated December 27, 1996.
The FAA has determined the proposed tank site is identified as an obstruction under the Federal Aviation
Regulations, Code 77, Subpart C, but would not be a hazard to air navigation. The City has been ask to
complete FAA Form 7460-2, Notice of Actual Construction or Alteration, Parts 1 and 2. This form will be
completed just prior to the start of construction and will used by the FAA to make the necessary adjustments
to the standard instrument approach procedure currently in affect. In addition, the tank must be obstruction
marked and lighted per FAA regulations. We have provided for obstruction lighting in the preliminary
construction plans. Special painting or other marking is not required by the FAA.
As you requested, we have visited with Mr. Bruce Beard, the FAA Obstruction Evaluation Specialist who
issued the Acknowledgment. Bruce explained that the standard instrument approach procedure at Dallas/Ft.
Worth International Airport will be modified in the vertical direction only as a result of this tank project. He
anticipated no lateral adjustments of the instrument approach patterns. He will provide a more detailed
written explanation at the City's request. We are enclosing a draft letter for your use in making this request.

The Federal Aviation Administration hereby acknowledges receipt of notice dated November 18, 1996 conceming the
proposed construction or alteration described above.
A study has been conducted under the provisions of Part 77 of the Federal Aviation Regulations to determine whether the proposed construction
would be an obstruction to air navigation, whether it should be marked and lighted to enhance safety in air navigation, and whether supplemental
notice of start and completion of construction is required to permit timely charting and notification to airmen. The findings of that study are as
follows.

[] The proposed conetruotion is not identified as an obatruction under the standards of FAR, Part 77, Subpart C and would not be a
hazard to air navigation.

This determination does not include temporary construction equipment
such as cranes, derricks, etc., which may be used during the actual
construction phase of this proposal. Such equipment which has a
height greater than the proposed structure requires separate notice.

to the FAA in a very timely manner. We will use both Pads 1 and 2 as

Today by telephone, we spoke with both Linda Steele (817) 222-5539, and Bruce Beard (817) 222-5536, of
the FAA regarding the Acknowledgment of Notice of Proposed Construction or Alteration, dated
December 27, 1996. In general, the Acknowledgment appears to deny the City's application due to violations
of the CFR Part 77 Obstruction Standards, and recommends the proposed structure be no higher than elevation
670 MSL. The high water elevation for the tank is planned to be 672.5 MSL and matches the HWL in the
existing tank. The expected top elevation of the tank in between 690 and 700 MSL.
Bruce explained that based on the project location, FAA notification is not required. However, the project will
have an impact on DFW's approach patterns. Therefore, they issued the acknowledgment with a
recommended lower elevation. I reminded both Linda and Bruce that the City of Coppell submitted a
preliminary notification application in July of 1996, and the determination at that time was that there was no
Part 77 conflicts.
Ken, here is where it gets confusing:
Bruce went on to say that there is still no Part 77 conflicts (even though that is what is indicated on the FAA
response). The acknowledgment determination was based on approach patterns for a seldom used approach by
DFW. He suggested two options available to the City at this time:
1. Since notification is not required, ignore the Acknowledgment we now have and build the Tank. Once the
tank is completed, submit as-built records to the FAA so that the approach paths to DFW can be modified.
I explained to Bruce that this was an unacceptable solution to the City of Coppell. We currently
have on record a determination by the FAA that appears to be an denial for this project. Neither
the City nor Shimek, Jacobs and Finklea are in a position to take on the resulting liability and
exposure from the course of action he suggested.
2. Have the FAA issue a supplemental determination that further explains their initial determination and
which will allow the construction of the tank project as planned, as long as the City provides as-built plans
to the FAA and provides obstruction lighting in accordance with the FAA guidelines. After the project is
complete, the FAA will work with DFW to make the necessary changes in the approach patterns. Bruce

Enclosed is a completed copy of the FAA Notice of Proposed Construction or Alteration for
the City of Coppell's proposed Wagon Wheel Ranch 2.0 million gallon Elevated Storage
Tank. The new tank will be located in the northwestern portion of Coppell near Highway
121 and Sandy Lake Road. Enclosed is a partial copy of the U.S.G.S. quadrangle map of
the area along with a City street map showing the project location. There is also a copy
of our preliminary site plan for the project provided for your information. Although the
site plan is not in its final form, it does show the elevated storage tank in its expected
location.
The detailed plans and specifications for this project should be complete in early December
of this year and bids taken for construction in either late December or early January of
next year. Construction of the project should begin early 1997, and be completed in late
spring or early summer of 1998.

Following is a memo concerning the proposed elevated storage tank site relative to the Federal
Aviation Administration's review. We were concerned with the site and potential conflict with
D/FW Airport's runway expansions. The preliminary findings indicate the site is within the FAA
flight parameters.
I thought this information might be useful at tonight's City Council meeting. I will be in Coppeli
at 4:00 p.m. to visit the pump station and ground storage tank site and expect to attend the Council

Although you have not directed us to do so, we have contacted the Federal Aviation Administration to discuss
the elevated storage tank site the City of Coppell is considering. Since the exact tank site location has yet to
be determined, we prepared an exhibit showing the extreme limits of the probable locations along with
approximate elevations. We forwarded this information to the FAA.
The FAA conducted a preliminary Flight Parmeter investigation using the information we provided. Their
preliminary investigation found that this site is within the FAA flight parameters for an elevated storage tank at
the anticipated heights shown. They cautioned that the results are preliminary and that a formal investigation
would need to be conducted once the exact tank location is determined.

The proposed construction would be located approximately 18,813
feet north Runway 17C at the DFW International Airport, DFW, Texas.
It would exceed the obstruction standards of the Code of Federal
Regulations, Part 77, as follows:
· Section 77.23 (a)(3) by 30 feet - a height that increases minimum
instrument flight altitude within a terminal area (TERP's criteria). The
proposal would require increasing the minimum descent altitude of the
LOC RWY 17C instrument approach procedure. The no effect heiqht
would be 145 feet AGL / 670 feet AMSL.
~ A favorable determination can be issued immediately at a structure
height of 145 feet AGL / 670 feet AMSL. Based on the significant
impact a 175-foot AGL / 700-foot AMSL structure will have on the
instrument approach procedure serving the DFW International Airport,
the maximum height the FAA will consider at your proposed location is
145 feet AGL / 670 feet AMSL. ~
