In August of 1989, the Texas Water Commission (TWC) adopted rules
relating to the registration of aboveground storage tanks (ASTs).
Copies of these rules are available from the Texas Register at P. O.
Box 13824, Austin, Texas 78711-3824. Copies are also available
through several state agency rules distributors in the Austin area.
You will need to request Subchapters B and F in Chapter 334 of the
Texas Water Commission Rules as published on August 15, 1989.
The Commission is in the process of making changes to the AST rules
in regard to the types of AST's which must be registered. Until
such changes are final, the following types of aboveground storage
tanks should be registered:
AST's with a capacity of more than 1,100 gallons which store
gasoline, diesel, kerosene, gasohol, aviation gasoline, distil-
late fuel oil, or other fuel that can be used to propel motor
vehicles.
Enclosed is a form for registering ASTs. On the form, listed under
"General Information" are specific types of tanks that are exempted
by law from the registration requirements. It should also be noted
that the TWC is proposing that aboveground emergency spill contain-
ment tanks, transformers or other electrical equipment also be
excluded from the registration requirements, regardless of tank size
or product stored.
If you have an AST that is subject to the registration requirements,
please use the registration form attached to this letter or a
photocopy of it. Fill the form out completely and mail it to the
return address listed on the top of the form. At this time, the
commission is not registering any other aboveground storage tanks.
