RE: Right -of -Way Use Permit Application
Dear Mr. Massie:
The pen-nit application you submitted for work to be done throughout the City of Coppell is
being returned to you. The request to perfonn a combination of aerial and underground
installation is denied based on the following:
Ordinance 2001 -944, Section 6 -14 -5, Paragraph B.
"A person shall not place or cause to be placed any permanent above ground
improvements or facilities, except as authorized prior to the effective date of this
Article, by franchise or authority of City Council by variance to the municipal
subdivision regulations."
Your proposed facilities must be installed underground unless you have requested and
received a variance to the ordinance. You may redesign your proposed project and
resubmit a permit application that specifies underground placement, or you may approach
the City Council for a variance to the ROW Use and Maintenance Ordinance.
