This is in response to the letter I received from you on October 23, 2000 concerning the
installation of a private fiber optic network.
We look forward to working with you on this exciting project. As you know, the City of
Carrollton is very supportive of Carrollton- Farmers Branch ISD's efforts to serve the
community's children. For this reason, we are fully prepared to expedite our permitting
and review processes. Additionally, if you are receptive, we are willing to pursue a
coordinated review process, involving other cities within which the network will be
located.
Regarding your request to waive right -of -way fees, please be aware that there are legal
requirements to be satisfied. Specifically, the Carrollton Charter gives the City Council
authority over right -of -way use and requires them to obtain "just and reasonable
compensation to the City for such use or occupancy." Similarly, other municipalities are
governed by Texas constitutional provisions applicable to waivers of fees. If the District
would prefer not to pay fees as prescribed by City ordinance, we would be willing to
pursue alternative compensation methods. We would consider alternatives such as;
1) access to and use of the network for municipal facilities; 2) access to District
recreational facilities; or 3) other reasonable compensation methods and combinations
commensurate with the value of fees waived.
