RE: FiberLight, LLC — CTP Registration within the City of Coppell, TX
Dear Mr. Rosales:
FiberLight, LLC ( "FiberLight "), hereby provides the following
information to the City of Coppell, Texas ( "City ") in order to register as a
Certificated Telecommunications Provider ( "CTP ") within the City. FiberLight
is a privately held limited liability company formed on March 17, 2005, under
the laws of the State of Delaware. As a privately held company, FiberLight
does not issue annual reports or submit any financial filings with the U.S.
Securities and Exchange Commission, and does not prepare or release public
financial statements and ownership information.
On September 8, 2005, in Docket No. 31459, the Public Utility
Commission of Texas ( "Commission ") granted FiberLight's application for a
service provider certificate of operating authority ( "SPCOA ") to provide
facilities- based, data, and resale telecommunications services for the exchanges
of SBC Texas throughout the State of Texas. FiberLight initially will only
provide private line, Internet access, dark fiber, and data transmission services
over the pre- existing telecommunications facilities located within the City's
public rights -of -way. At this time, FiberLight does not intend to offer
residential and /or business dial tone services. FiberLight may expand its
service offerings to include more local and interexchange services.
Since FiberLight qualifies, as a CTP as defined in Section 283.002(2),
Texas Local Government Code, FiberLight understands that no formal
franchise agreement is required from the City to operate and maintain
telecommunications facilities. Therefore, FiberLight provides this letter and
the accompanying information in order to register with the City as a CTP.
Currently, FiberLight seeks authorization from the City to construct
new aerial facilities, by attaching the facilities to existing power poles within

the City. All facility attachments will be constructed in accordance with Oncor
guidelines and reviewed by Oncor. FiberLight will not be setting any new
poles within the City, and will construct underground facilities where no aerial
facilities presently exist. In addition, FiberLight will place its facilities
underground in instances where the existing power poles are congested and
unable to accommodate additional attachments.
FiberLight would like to complete the registration process as
expeditiously as possible. To that end, FiberLight provides the following

As indicated above, on September 8, 2005, the Texas Commission
authorized FiberLight to provide of facilities- based, data and resale
telecommunications services in the SBC Texas exchanges throughout the State
of Texas. (SPCOA No. 60736). As a holder of a SPCOA, FiberLight qualifies as
a CTP under Section 283.002(2), Texas Local Government Code.
