Proposed Change Order ~1
Dear Mr. Doyle:
We are in receipt of your February 15, 1989 letter, received
on February 27, 1989, and wish to offer the following additional
info~ation for your consideration.
The general contractor on the 4 MG ground storage tank is Preload
Construction Company of Garden City, New York. They moved onto
the site in mid Septe~er of 1988. At that time, Kimbel Kourt
had numerous cracks and exhibited the initial stages of pavement
failure.
In our opinion, Kimbel Kourt was a sub-standard city street
before Preload began construction operations. The construction
contracts (with Preload & Cajun) do not contain provisions for
the repair or maintenance of city streets. The contracts were
bid in good faith that the City of Coppell's streets could
withstand normal construction traffic. A contractor can be
required to repair damages; however, proving his damages on a
sub-standard street will be difficult. The hard freeze in late
January was very damaging to most asphalt streets. Even roadways
constructed to much stricter standards (i.e. Hwy. 121)
experienced significant pavement failures.
In summary, we feel the Contractors' have a valid claim not to
repair Kimbel Kourt. They do have a responsibility to keep the
adjacent roadways clear of debris and mud caused by their
operations and we have instructed both Cajun and Preload to
better police this situation.
As you are aware, the pump station contract is lump sum.
Therefore, bid unit prices are not available for evaluation of
this Change Order. Cajun Contractors has provided us with a
detailed cost breakdown of the work to be deleted and added (see
attached). The following is a brief summary of their cost
breakdown for the items involved in the proposed Change Order.

C. Utility Conflicts: Two conflicts have been discovered which
have necessitated a realignment or alteration to the
proposed 36" water line along Sandy Lake Road.
1. Discharge Line from Sandy Lake Road Pump Station. The
fill line to the existing ground storage tank on Sandy
Lake Road is shown on the plans at elevation ±430.
This elevation was taken from the drawings of the
existing station which were provided to us by the city
of Coppell. In actuality, the fill line is at
elevation ±437 which poses a conflict with the proposed
36" line to the Village Parkway Reservoir and the
existing discharge line of the Sandy Lake Road Pump
Station. Since it is impractical, if not impossible to
adjust the existing discharge line, one (1) additional
bend is being used to go underneath the discharge line.
Add one (1) - 14° L-301 Bend @ $1,600/Ea $ 1,600
2. Realign Crossing of Sandy Lake Road. The 48" jack and
bore crossing of Sandy Lake Road has been realigned for
two reasons. The amount of working room needed for
bore pits is projected to be approximately 32'long by
13' deep. At the original angle of 45°, this would have
required removing either the entire intersection of
Kimbel Kourt and Sandy Lake or one of the bridges into
the Corners of Coppell shopping center. The angled
crossing would also have caused extensive damage to
Bonhards Nursery's landscaping (which is in the right-
of-way). We proposed to realign this to a
perpendicular crossing to minimize damage to the
landscaping and intersection.

In exchange for the above considerations, Cajun has offered to
scarify, pulverize, and recompact Kimbel Kourt and then apply a
2" HMACP overlay. We have proposed the following specifications
for the pavement work:
1) Scarify and Pulverize ±6" in accordance with Texas State
Department of Highways and Public Transportation Standard
Specifications (TSDHPTSS) Item 250 (Ordinary Compaction).
2) Add Emulsified Asphalt (TSDHPTSS Item 314) at a rate of ±0.5
gal./sq, yd. prior to recompaction.
3) Overlay recompacted subgrade with 2" of Hot Mix Asphaltic
Pavement (HMACP) Type D in accordance with TSDHPTSS Item
340.
Access will be provided to all tracts at all times. Open cut
operations will commence and be completed within 3-4 weeks of
approval of this Change Order. Resurfacing of Kimbel Kourt will
occur in September or October after completion of most heavy
construction operations.
It is our estimate that the resurfacing of Kimbel Kourt would
cost the City approximately $15,000. Cajun has proposed this
resurfacing for a cost of $8,515 which would make the Change
Order a net zero in both time and money to the contract.

We have forwarded the road resurfacing specifications and
additional recompaction specifications for the Kimbel Kourt open
cut to Cajun for their evaluation. If their position on this
proposed Change Order changes due to the clarification of these
points, we will notify you.
Thank you for your consideration of this proposed Change Order.
We feel it will be beneficial to the project and allow the City
to accomplish the resurfacing of Kimbel Kourt without the
expenditure of additional funds. As we stated in our March 3,
1989 meeting, time is of the essence for approval. Any
significant delays in approval may remove the Contractors
incentive to pursue the Change Order and cause time delays to the
project.

RE: VILLAGE PARKWAY PUMP STATION CHANGE ORDER #1 REQUEST
Dear Mr. Case:
I am in receipt of your February 1, 1989, letter which was received on
February 10, 1989 for the above subject change order. It appears that the
project has been evaluated and sized up early in its life, but there are
some items I will need to know before ! can comfortably recommend this
change order as presented. (This is as I discussed with John Karlsruher
at the February 14, 1989 City Council meeting).
.. Some information will need to come from you, the Project Enginer, and or
the Contractor and some will need to be received from the other related
officials copied on this letter. When you have your data and information
gathered and transmitted then we can set up a meeting to consider the
other ramifications and needs. (As John Karlsruher and I discussed on
Tuesday evening, you can still call this meeting as soon as possible).
CONDITIONS OF KIMBEL KOURT- Please brief me of the responsibility
of the contractors building the 4MG ground storage tank and the
Village Parkway Pump station regarding city streets and damage caused
by their construction equipment. (The ground storage tank contractor
is not listed in the February 10, 1989 monthly report.) Please refer
to the attached February 14, 1989 Public Works memo.
What does the beginning project photographs and/or Project Engineer
personnel show for the condition of Kimbel Kourt prior to
construction.
Items 1 through 3 of your proposal suggest a traditional reduction in
unit costs (i.e., boring vs. open cut). Please provide what those
unit costs (or at least total costs) are per contract (boring) and as
estimated for open cut. Preferable provide unit costs and a total
cost by each segment of the project cited.
With the four lean conditions listed for open cuts, it is assumed that all
other requirements and specifications are provided in the contract or by
the City of Coppell standards. Please confirm.
Related to the three offerings: Why is the adjustment of the 36" water
main necessary on items 1 and 2. Was it not planned for (i.e., project
line item)? Just found out? Not the contractor's-responsibility within
the contract? What are the specific utility conflicts?
Concerning item #3 of the offerings, what specification will be followed
in the pulverizing, recompaction progress. Will rejuvating compounds be
utilized? What quality control will be used? Will any new asphalt be
mixed into the existing pavement? Do we know the pavement cross-sections
etc.?
Please provide estimated costs on all these offerings for appropriate
considerations and comparisons. As we discussed, this may be a wash
funding-wise, but we must be accountable for the deal.
Regarding the closing of Kimbel Kourt, etc., we need to have that
coordination meeting for good planning, coordination and public relations.
We need to know, the timings and sequencing of the activities addressed in
this Change order (e.g., "how brief of a period" will the old police
station be denied access). Have these property owners and businesses been
approached on these requests?
Even though you recommend this deal is in the best interest of the City of
Coppell, I believe when we receive the information requested herein and
have the coordination meeting with the other City Department Heads, then
we can better tell the bottom line and more importantly carry it to the
City Manager and eventually the City Council as a part of the total
completion of this Capital Improvement Project.
Again, while the change orders bottom line is a wash, it will be healthy
to know that the values of trade-offs are. I trust that this request and
generation of the information will not prove adverse to the best interests
of the Cityp~ Coppell. Your continued commitment to that end will be
greatly appfe/iated. Thank you.

Change Order #1
Dear Mr. Doyle:
As you are aware, the condition of Kimbal Kourt has deteriorated
due in part to the increased traffic related to construction of
the 4.0 MG ground storage tank. With the pump station just
beginning construction, the road condition is expected to further
worsen. To correct this condition, Cajun Contractors, Inc. has
approached us with the following proposal:
1) Replace the proposed 48" bored crossings along Sandy Lake
Road at Station 24+10, 27+01, and 30+55 with open cut
crossings. These crossings are at entrances to the Corners
of Coppell shopping center.
2) Replace the proposed 24" bored crossings along Kimbal Kourt
at Station 32+74 and 33+72 with open cut crossings. These
crossings are at entrances to the Stop-N-Go strip center.
3) Replace the proposed 24" bored crossing of Kimbal Kourt at
Station 36+90 with an open cut crossing.
All open cut crossings will be subject to the following
conditions:
1) No more than one (1) entrance to the Corners of Coppell
~hopping center will be closed at any time.
2) No more than one (1) entrance to the Stop-N-Go strip center
will be closed at any time.
3) All concrete drives will be saw cut or removed at expansion
joints and replaced per original condition.
4) All open cut operations will be performed in the public
right-of-way.

In exchange for allowing the above open cut crossings, the
contractor is offering the following:
1) Adjust the proposed 36" water main at station 10+87 to avoid
utility conflicts.
2) Adjust the proposed 36" water main at Sandy Lake Road to
avoid utility conflicts.
3) Prior to completion of the Village Parkway Pump Station
project, Cajun Contractors, Inc. will pulverize, recompact,
and install a 2" H.M.A.C. surface to Kimbal Kourt from Sandy
Lake Road to Village Parkway.
We wish to note that this work will require Kimbal Kourt to be
closed during the boring of Sandy Lake Road, the open cutting at
Station 36+90, and for resurfacing. The only facility which will
be briefly denied access during this process is the old Police
Station on Kimbal Kourt.
The contractor has proposed this Change Order at no change to the
contract amount. We believe it is in the City's best interest to
accept this change order.
If you concur, please forward this Change Order to Mr. Ratliff
for his approval. If we can be of further assistance or if you
have any questions, please contact us.

I was required to make an inspection of the road Kimbell Kt. recently
due to complaints received. The road's condition, as expected,
has deteriorated rapidly due to the heavy loads experienced during
the continuing construction of the new ground storage facility.
This condition has also been duly noted by the Director of Public
Works.
Please have the Contractor submit his intentions for the repair
of directly affected portions of that road and for street sweeping
of Kimbell Kt., Village Pkwy., and MacArthur Blvd., which have been
tracked with dirt from the construction site. This should be accom-
plished within a reasonable period of time after operations which
have caused these situations to occur or when deemed necessary to
prevent loss of life or property.

Dear Mr. Hirschey:
On March 3, 1989, we meet with the City staff to discuss the
proposed Change Order #1. Prior to forwarding this item to the
City Manager, several clarifications have been noted by the staff -'
as conditions for their consideration. They are as follows:
Open Cutting of Kimbel Kourt
1. Access shall be maintained to all tracts at all times during
the open cutting operation. Cajun should coordinate its
activities with the property owners to minimize disruption
to business's.
2. After installation of the 16" pipe, backfill shall placed in
layers not exceeding 8 inches and compacted to 95% standard
proctor at ±3% of optimum moisture. Compaction of backfill
.- by inundation with water will not be permitted.
3. Provide and maintain a temporary asphalt driving surface
over the open cut trench until road is resurfaced.
Resurfacing of Kimbel Kourt
1. Access shall be maintained to all tracts at all times during
the resurfacing operation. Cajun should coordinate its
activities with the property owners to minimize disruption
to business's.
2. Scarify and Pulverize ±6" in accordance with Texas State
