Dear Ms. Garmen:
Recently you requested from the City Engineering staff some information regarding the payment of park
fees and development of the dedicated trail within your subdivision Cambridge Manor. In order to clarify
the situation, we are responding to your request with some relevant data regarding park fee payments and
legal opinions rendered regarding the payment of fees and the development of the trail.
First of all, park fees in the amount of $59,110.00 were paid on July 19, 1994 by the developer to the
City of Coppell in accordance with applicable City Ordinances. This money is placed in a restricted
fund, which is divided into two parts. One portion of the fund is utilized for development of public park
property west of Denton Tap, and the other for public park property east of Denton Tap.
Secondly, the developer has dedicated the easement necessary for the trail to be developed through
Cambridge Manor on the south side of Denton Creek. According to a legal opinion rendered by the City
Attorney, the developer is responsible for payment of park fees, or the development of any required
recreational facilities by the City. In this case the City chose to receive the fees in the previously stated
amount. The developer has no financial liability for the development of the park trail under City
Ordinances or State Law.
