Dear Mr. Hirschey:
We are in receipt of your October 5, 1989 letter requesting a 131 day
extension of contract time. We are evaluating your request and will forward a
recommendation to the Owner at the time of a request for final payment. We
recognize that portions of the offsite work were inundated with flood waters
during the period; however, many other factors must be examined in order to
determine if and/or how much of an extension is warranted. These include:
1) Little activity has occurred on the offsite waterline since August 28,
1989. The Corps of Engineers forecast the late August date for
discontinuation of floodwater release for more than six weeks. Could
mobilizations and construction activities have been scheduled for a more
timely resumption of work, thus allowing completion within the contract
time?
2) Could the work have been completed within the available number of days
before and after the flooding?
3) Was the of f site work performed in a timely, efficient, and workmanlike
manner?
We will advise you of our recommendation in the near future. In the interim,
we wish to remind you that the contract completion date for this project will
remain November 22, 1989 until formally extended by the Owner. We request
that you dedicate your full efforts to achieving substantial completion of the
project by that date.
