Dear Mr. Hirschey:
As we stated in our ~/uly 13, 1989 letter, the contract requires you to verify
utilities and notify the owner of the utility prior to construction in the
area. This is to allow the utility owner and the Engineer the opportunity to
evaluate alternatives for eliminating the conflict. When adequate advance
notification is given, available alternatives include relocation by the
utility owners' forces, relocation by separate contract, relocation by change
order, or alteration of design to avoid the conflict. Your failure to verify
the conflict and provide advance notification to the utility owner and
Engineer removed the Owners options which are available under the Contract.
We also must take exception to the requested amount of this change order. The
City of Coppell currently has two contracts in force which include pay items
for similar work. The Denton Tap Road project has a pay item for "8 inch
Waterline Lowerings" (including all fittings) at $21.00/LF. The 24" Cross-
town Waterline project has a bid item for "10 inch Waterline Lowering"
(including all fittings) at $25.80/LF. Based on an estimate of approximately
16 LF involved in this relocation, your unit cost is $181.69/LF. We believe
this to be excessive.
The contract clearly states that no extra claims for compensation will be
allowed for utility relocations unless approved in writing prior to the
relocation. No request was submitted for this item prior to the work being
performed, and thus, we are unable to recommend approval to the Owner. Should
you have additional information regarding this matter, please forward it for
our review.
