Substantial Completion
This writing is offered in response to your letter of July 9. Before I discuss
the current status of completion, I wanted to relate my phone call to Scott
Latta., this afternoon,. As far as the "As Built" drawings are concerned, Scott
needs the individual sheets separately signed and dated. Even though Tim
Bennett, PE supplied electronic files in the PDF format, Scott wants all
sheets in a "drawing" file format, so they will be compatible with the City's
interactive CAD system. Tim suspended his private engineering practice for
an extended commitment to the City of Piano Engineering Department.
Tim is happy to individually sign and date the drawings; However, he is
unable to provide drawing files, because his CAD operator is permanently
unavailable and the hard drive daily work files are irretrievable, for the
purpose of making the required drawing files. Tim is going to talk to Scott
about his dilemma and hopefully they can work something out.
The sidewalk is complete and in the proper location, as approved by the
City Inspector. The intersection tie in cannot be completed until Bethel
Road is repaved and the turn lane is constructed. A short retaining wall is
yet to be built by TR-W, LP, which will stabilize the soil under the rock
wall footer down to the walk. Terradyne is going to place curlex around
the sidewalk and replace the erosion control along Denton Tap..
The curlex is in place, along the parkway, on the front of the lots and all
inlets have the proper erosion control devices at their throats. All other
interior erosion control will be maintained properly.
All lots have been final graded, in accordance with the grading plan, which
provides for each lot to have positive drainage away from the building pads.

The surveyors, for Jiunes Arnold Const., have confirmed the final building
pad elevation for each lot and the "as built" elevation is shown on the
attached list dated July 9. Tom Ellis, with Alpha Testing, has issued a
certification letter, to David Weekley, verifying that all lots meet the
minimum requirements of the City, with regard to moisture content and
compaction density. Please accept the foregoing statement and the list of
as built pad elevations, as my "verification letter" for same.
Jeff Curry, with 4ncor Electric, has procured (3) decorative street lights,
identical to the one on Bethel Road. The 3 cobra head lights are coming
down, to be replaced by the decorative lights. 4ncor is going to eliminate
the poles on Bethel and put everything underground, at the request of the
new owner /developer of the Baptist Church 20 acre tract.
This coming week, Sempco Surveying will be placing the final steel rods
for all lot corners. Wherever a lot comer falls within the structure of a
retaining wall or the perimeter rock wall, a 5' offset will be used and
marked accordingly. Creek lots will have steel rods placed at the 100
year flood plain line„ as shown by sideline distances on the final plat.
The Entry Towers are almost completed and we have the identity signage
and artistic wrought iron accessories yet to install. We are going to heavily
landscape the areas around the towers and in front of our intersection sign.
The lots are 100% completed, in every sense and each one is suitable for a
building permit to be issued. The City has received the Maintenance Bonds
from Barson Utilities. With the sole exception of some inconsequential
technicalities, I see no reason why a letter of substantial completion cannot
be issued. For all intents and purposes, we are completely in compliance
with your July 9 letter. Please obtain the appropriate approval and provide
the requisite letter acknowledging your acceptance of the final walk thru and
substantial completion, or a writing stating your specific material reasons for
not doing so. Thank You...
