Discussion and approval of a resolution accepting the engineer' s estimate of cost
for the East Beltline Road Water Line Installation Project #WA 94-01,
determining the necessity for an assessment of a portion of the costs against the
benefitted properties, providing for notice, and public hearing to determine an
assessment and approval of Notice of Proposed Improvements and authorizing the
Mayor to sign.
Staff is continuing to follow the process to insure that a portion of the cost for the East Beltline
Water Line Improvements can be assessed against the benefitted properties adjacent to the
proposed water line. Because of notification requirements and the need for appraisals of the
property, a public hearing will be held on January 10, 1995 concerning these assessments. The
actual amount to be assessed will be based on the actual construction cost and the results of the
appraisals determining the enhancement to the property by virtue of the installation of the water
line. Prior to the public hearing, notices will be sent to all property owners adjacent to the
water line. Staff will be available to answer any questions at the Council meeting.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS,
APPROVING THE ESTIMATE OF COST FOR IMPROVEMENTS TO THE WATER
WORKS SYSTEM ON BELT LINE ROAD; APPORTIONING THE COST OF THE
IMPROVEMENTS THAT MAY BE ASSESSED AGAINST THE BENEFITrED
PROPERTY AND THE OWNERS OF THE PROPERTY; PROVIDING FOR THE FILING
OF NOTICE OF THE CITY'S INTENT TO ASSESS A PORTION OF THE COST OF THE
IMPROVEMENTS AGAINST BENEFITrED PROPERTY; PROVIDING FOR A PUBLIC
HEARING AND NOTICE OF THE PUBLIC HEARING. TO DETERMINE
ASSESSMENTS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City of Coppell has heretofore adopted the provisions of
Subchapter D, Chapter 402, Texas Local Government Code, with regard to improving the
water works system by constructing improvements thereto and providing for the
assessment of a portion of the cost against the benefitted property and the owners of that
property; and
WHEREAS, the City Council has determined that there is a need for improvements
to the water works system by construction of 12" and 8" water lines along the south side
of Belt Line Road, and other improvements; and
WHEREAS, the City Engineer was directed to prepare and submit detailed plans,
specifications and cost estimates for such improvements; and
WHEREAS, such items have been prepared and submitted and it is the desire of
the City Council to call a public hearing to levy an assessment against the benefitted
property and the owners of that property for a portion of the estimated cost of the
improvements;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the Engineer's estimate of costs of the East Belt Line
Road water line installation (WA94-01) attached hereto as Exhibit "A", be, and the same
is hereby, approved and accepted in all respects for the purposes set out in Chapter 402
of the Local Government Code.
SECTION 2. That it is the intent of the City of Coppell to apportion the part
of the cost of those improvements that may be assessed against the benefrtted property
and the owners of the property, among the parcels of the benefitted property and the
owners, on a per front foot basis as provided by Chapter 402.
SECTION 3. That the City Engineer is hereby directed to record a Notice
of Proposed Improvements so that the City may levy or assess not more than 9/10 of the
estimated cost of the improvements against the benefitted property and the owners of that
property, that such notice be signed by the Mayor on behalf of the City Council, and that
the notice be filed with the County Clerk of Dallas County, the County in which the
property is located. That such notice substantially show the items required by Section
402.067 of the Texas Local Government Code. The form of such Notice is attached
hereto as Exhibit "B".
SECTION 4. That a public hearin on the question of such assessments is

Council and each person who owns or claims benefitted property or an interest in that

property is entitled to be heard on any matter relevant to the assessment. Written notice
of the public hearing shall be mailed to the address of the owner of the property or to the
person who last paid taxes on the property as determined by the City tax rolls. The
notice must be mailed before the 10th day before the date of the hearing and shall be
published three times in the newspaper of general circulation in the City, the first of which
shall be before the 10th day before the date set for the hearing. A list of the owners and
their addresses is attached hereto as Exhibit "C" and made part hereof for all purposes.
SECTION 5. This resolution shall take effect immediately from and after its
passage, and it is accordingly so resolved.
DULY PASSED and approved by the City Council of the City of Coppell, Texas,
