We have performed an administrative review of this report and offer the following comments. The annual report appears to include all of the _required information and is considered administratively complete. For your reference, we have attached a copy of the checklist we utilized for this review. Additional information may be requested in the future as part of technical review, an inspection, or an audit. If there are any differences between the approved Storm Water Management Program (SWMP) and the information provided in this report or future reports, you must submit a Notice of Change (NOC), Texas Commission on Environmental Quality (TCEQ) Form (TCEQ - 20392), as required by the general permit. The annual report for the fourth permit year (August 13, 2010 through August 12, 2011) is due on November 12, 2011. TCEQ has a report form available, and we strongly encourage MS4 operators to continue to use the template in preparing and submitting subsequent reports. This will greatly assist us in revieMng the reports, and will help to insure that we provide a timely response to permittees. Beginning with the Year 4 annual reports, we will be performing a comprehensive technical review to determine whether adequate progress is being made towards implementation of the approved SWMP. Please make sure to also forward a copy of your annual reports to the TCEQ regional office. Finally, please be aware that discharges of the constituent(s) of concern to impaired water bodies for which there is a total maximum daily load (TMDL) implementation plan are not eligible for this general permit unless they are consistent with the approved TMDL and the implementation plan. Permitted MS4 operators must incorporate the limitations, conditions and requirements applicable to their discharges, including monitoring frequency and reporting required by TCEQ rules, into their SWMP in order to continue to be eligible for coverage under the general permit. If the discharge is no longer eligible for coverage under the general permit, then the MS4 operator would be required to apply for and receive an individual TPDES permit. P.O.
