We have received the annual report for the City of Coppell Phase II MS4 that was submitted on
November 6, 2012, for the Year 5 reporting period for the above - referenced permit authorization. We
have performed an administrative and technical review of this report and offer the following comments.
The annual report appears to include all of the required information and is considered complete. For
your reference, we have attached a copy of the checklist we utilized for this review. Additional
information may be requested in the future as part of an inspection or an audit to determine whether
adequate progress is being made towards implementation of the approved Stormwater Management
Program (SWMP).
If there are any differences between the approved SWMP and the information provided in this report or
future reports, you must submit a Notice of Change (NOC), Texas Commission on Environmental
Quality (TCEQ) Form (TCEQ - 20392), as required by the Phase II MS4 General Permit (TXR040000).
The Phase II MS4 General Permit expired on August 12, 2012, and is currently being renewed with a
delayed issuance. The existing permit has been administratively continued until the new permit is
issued. Until such date, you are required to continue to operate under the existing permit, implement
your approved SWMP, and comply with all reporting requirements.
If the new general permit is not issued by the time your reporting period ends, your next annual report
will still be due November 12, 2013. If the new general permit is issued by then, then your annual
report for the first permit year will be due as specified in the permit. The TCEQ has a report form
available, and we strongly encourage MS4 operators to continue to use the template in preparing and
submitting subsequent reports. This will greatly assist us in reviewing the reports, and will help to
insure that we provide a timely response to permittees. Please make sure to also forward a copy
of your annual reports to the local TCEQ regional office.

Finally, please be aware that discharges of the pollutant(s) of concern to impaired water bodies for
which there is a total maximum daily load (TMDL) implementation plan are not eligible for the Phase II
MS4 General Permit unless they are consistent with the approved TMDL and the associated
implementation plan.
Permitted MS4 operators must incorporate the limitations, conditions and requirements applicable to
their discharges, including monitoring frequency and reporting required by TCEQ rules, into their
SWMP in order to continue to be eligible for coverage under the general permit. If the discharge is no
longer eligible for coverage under the Phase II MS4 General Permit, then the MS4 operator would be
required to apply for and receive an individual TPDES permit.
