I am in receipt of your letter to Mr. Pier dated August 26, 2009 regarding the Sandy Lake Road Project. The Piers requested that I convey to you their own determination of a fair value of the Property. Mr. Pier has calculated a fair value for the Property to be $108,247.11, based on his original $871,789 purchase price for the Lot and then applying the following factors: Original Purchase Price ($4.11 per square foot) x 21,518.64 square feet (0.494 acres): $88,441.61 9.5% Appreciation: Proportionate Share of Property Taxes Paid: $11,403.55 Total Fair Value: $ 8,401.95 $108,247.11 The appreciation percentage is from data obtained from www.neighborhoodscount.com which indicates that the area in which the Property is located is among the highest appreciating areas in the State and 510895 5301 SPRING VALLEY RD, SUITE 200 1 DALLAS, TEXAS 75254 0 972.788.1400 F 972.788.2667 WWW.FFLAWOFFICE.COM Mr. Keith Marvin, P.E. Also, a nearby 5.12 acre lot on Cottonwood Drive is currently listed for $1,069,000 ($4.79 per square foot), which would equate to a $103,032.90 value for the Property. In addition to the payment of the fair value for the Property as set forth above, the Piers request the following from the City of Coppell (the "City") in connection with the sale of the Property, at the City's expense: The City shall pay for all closing costs associated with the transaction. 2. The City shall pay for and relocate, if necessary, utility service (water lines, etc) located on or under the surface of the Property and/or Lot in connection with the widening of Sandy Lake Road. The City shall pay for and relocate, if necessary, electric lines and/or poles located on or under the Property and/or the Lot and to reconnect service. 4. The City shall replant or replace all trees removed as part of the Project, and to be replanted or replaced at locations on the Lot corresponding with their prior locations. The City shall relocated and/or replace the metal fencing on the current property line with the same quality fencing at the new property line, as mutually agreed upon between the parties. A site plan diagram will be prepared by the City regarding the new fence location. 6. The Piers desire to retain the oil, gas, and mineral interests rights under the surface of the Property being conveyed. As I explained to Raymond over the phone, the offer of $66,663.00 is a low offer that does not take into account the factors mentioned above. While the Piers desire to amicably and expeditiously resolve this matter, they expect to be fairly compensated for the Property and preserve its security and esthetics.
