Ok, I've got a little more information. First, our Building Official is Michael Arellano, and he can be reached at
972-304-3506. He told me to let you know that he would be glad to discuss any of your questions in greater
detail.
1. Yes, your setback from Sandy Lake road will apply to a new fence, or a new home. This is true of your
current setback, as well as the new setback that will be measured from the new property line. The square
footage of land encumbered by the setback will be no grater than the current area, however it will be 11.58 feet
closer to your existing house.
2. Your existing building is clear of the new setback.
3. A fence could be built today along the 40' setback without a variance. In the future a fence could be built
along the 30' setback without a variance. In any case a fence along the property line would require a variance.
Michael is the staff liaison to the Board of Adjustment, which is the board that would hear the variance request.
He was of the opinion that a request to place the fence on the property line would likely be denied.
4. You would not need a variance now, or in the future to rebuild the house in the current location. He did not
believe you would need a variance to rotate the house to face Sandy Lake Road.
5. The variance process is approximately 30 days. Submission deadlines are typically around the first of the
month, with the hearing taking place the first Thursday of the following month. This next cycle, the submission
deadline is March 5th, and the hearing date is April 1st.
6. Michael can answer the question of duration of the variance better than I can, but he did indicate that he
would work with you on the time frames due to the fact this was a city project that was creating the situation.
7. The plat is attached. Unfortunately I am not the artist that Gary Seib is, but I believe the pertinent
information is there.
8. Please ask your title company representative to call me, or if you will provide the contact information, I'll call
them to discuss this.
