The easement and fencing remuneration is deemed to be an agreed upon financial discussion and spec that everyone can live with... however, The set back request by the city will need a financial amount to be arrived at, because it will cause the value of the property to have a financial future impace on the value as is and future land available to developers. The set back request from the city will decrease the value of the property with the easement taking. The following are discussion points of resolution and solutions to be considered by the city, as the city can do the math, as well as physically see, if the easement left as is with set back is authorized, I could not get into my garage, would lose the driveway, and not allow me to place a privacy fence, because in fact, the city would own the easement; The city purchases the entire property for $345,000 (per appraisal), does the taking and "sells" remaining to a developer in ShadyDale acres (eg Holmes, Payne) for a spec build with set back and easement as a lot, since the city can afford to take an impact of property value loss vs the current owner; or The city agrees to allow a commercial zoning and /or residentil _yafiance — and assist in an expedious variance for the easement /set back, due to time is of the essence, allowing a ten room elder alzheimers home; which would face Sandy Lake Rd; or 3.
