I believe that you were previously given an Aerial Easement from Oncor’s representative to consider a 15-foot easement area.  The poles and wires being relocated will not be on your property.  They will be in the new Sandy Lake Road right of way.   If you can agree to the Tree Trimming Agreement, Oncor will reduce the area needed to 10-foot instead of 15-foot.  Again, this 10-foot area is needed to maintain a safe clearance around the electric power line. The term of this Agreement shall commence on the Effective Date and shall continue for so long as Oncor maintains its power line and/or other facilities running along the Property (the “Term”). 3. Oncor agrees to remove all trees, limbs and debris from the Strip and the Property, at its sole cost and expense, resulting from the tree trimming activity, and that such activity shall not be unreasonably disruptive of Owner’s use of the Property. 4. Oncor assumes all risks and responsibilities for accidents, injuries, or death resulting from injuries or damages to person or property occurring in, on, or about the Property, as a result of Oncor’s activities contemplated under this Agreement. Oncor agrees to indemnify and hold harmless Owner and Owner’s employees, agents, lessees, contractors, and assigns from any and all claims, liabilities, losses, costs, and expenses (including attorney’s fees) arising from, or in connection with, the tree trimming activities contemplated by this Agreement. 5. Owner agrees that it will keep confidential and will not disclose to any third party the amount of consideration paid by Oncor to Owner. 6.
