During the visit he suggested the City take the actions listed below in our i quiries of the workings of the channel as the local floodplain admi istrator supersedes the Water Commission's authority where they exis . A dialogue between the channel's engineers, our City Engineer, and Consulting Engineer should take place to correct any discrepancies. At regular intervals the silt in the man -made channel's interesections With the natural, channel be removed. The trees that ave fallen into the natural creek need to be removed as they will i pede river flow and at high flows cause debris to form log jams. The project has not been finalod and an extension of the construction period granted, according to Mt. Andrews. I would request that you ascertain a copy of the report sent the City of Coppell by DCLID, as well as any other information pertinent to this project from the Texas Water Commission. Advise Larry Jackson through a letter of what we are attempting to do and request: any information Larry may have which could provide an insight of tbe creation and operations of the Denton County Levee Improvement. I base this reconmendation on personal observations (as indicated by the enclosed photographs) of flows from Denton Creek flowing into the channel, reducing the velocity of the creek flow allowing for growth of aquatic vegetation. In the original order, a report to be sent the City by the DCLID would indicate the necessity of taking remedial action to insure this, correcting observed problems. I will contact the Levee Improvement District to obtain a copy of the report to the Commission outli ed. O. Box 478 Coppell, Texas 75019 214 -462-9010 I have been developing a file concerning the diversion channel north of the Denton Creek main channel within the Vista Ridge development. Mike Allen of Unvest had asked staff, through Alan Ratliff to look into this because the current flows in the main creek at this t Ime appear to be of less velocity than experienced in past years an5 of a lower wager level. I visited this area and took some photographs which show water flowing into b h channels at' each intersection with the other, but more promine tly from the creek into the diversion. The channel was built as a reclamation project under a ruling by the Texas Water Commission dated October 28, 1985. The commission in its ruling had stated construction be completed within two years of the date of ruling and that a study at the expense of the Denton County, Levee Improvement District #1 be compiled, deter ining any remedial action necessary due to the diversion of water. Have you any knowledge or information relating to this which may be helpful as the two requirements of the order remain unfulfil ed as of this date, according to James Mirabol of the Texas Watler Commission staff. Should you have further information on the creation, Board of Directors, or operations of the DCLID #1, I would very much like to review these, too. These plans indicate several intersections of the man made channel with the natural channel with no provision for diversion of water due to low flow. The photographs of these intersections taken by me further confirm this is occuring and the ecology of the main channel is changing from a fast moving, constant flow to a more passive flow, allowing for growth of al ae and other aquatic plants. I made several attempts to contact the Denton County Levee Improvement Dis rict #1 and did get someone who was delivering materials, answering the number as, "Vista Ridge pumping station ". Upon receiving this, I contacted the Texas Water Commission to speak with someone in their reclamation project division. I reached a James Mirabol who had some knowledge of the project and discussed the concerns I had and to obtain further information. Mr. Mirabol, du ing the discussions, looked over the commissions order and indica ed several discrepancies occuring: The first is that the project', was to have been completed within two years of the issuance of the order dated 28 October 1985. Mr. Mirabol and Mr. Don Andrews confirmed no final inspection has taken place or receipt of any documents stating completion on file at their office. The report ev ulating the performance (including flows) of structures during low flows prepared by the Denton County Levee Improvement District #1 has not been filed. The report was to analyze the effect, if any, of the diversion of water between the two channel;, propose any remedial action, if any, necessary to correct obs rued problems. Mr. Andrews is the hydrologist for our area and will be makin a visit to our area in late July. I have given him our number and address for the purpose of visiting with him to bec me more famil'ar with this issue. He will also be inspecting the channel at which I asked to be included to show him those areas of concern discussed over the phone. No new information, specifications or drawings have been sent to the Commission since this project started. This would indicate no changes have been made from the original plans approved by the Water Commission. The only action taking place that the Commission staff is aware of since the Commission ruled pctober 28, 1985 was a request from the Attorney General's office for a certificate of compliance, assuring the use of bonds for the program of reclamation proposed.
