Mockingbird Lane, Suite 230E Dallas, Texas 75247 Re: Coppell Road Reconstruction SH 121 to Sandy Lake Road Coppell Project #: ST 98-01 Dear Mr. Young: Before the City of Coppell would process our October 1999 partial pay estimate, we were required to annotate that 28 calendar days had elapsed on the project, indicating that time charges began on October 4, 1999, and were told to dispute that situation in writing. As you are aware, we disputed starting time charges on the project while the easement litigation prevented complete prosecution of the water line and construction of the box culvert, which were both critical path tasks. Additionally, the debate regarding constructing the box in one or two stages has prevented any progress on the box until that issue has been resolved. We resumed construction in the disputed easement area on November 12, 1999. Since the disputed easement wasn't available until that time, no time should have been charged in October 1999. Even though we resumed work on the water line and the easement conflict with the box culvert has been resolved, the construction method for the box culvert has not been finalized thus preventing any progress on the box. The box culvert is a critical path task. We do not agree that charging time prior to the availability of all of the critical path work is valid; therefore, we request that time charges be suspended until the box is available for construction and we have been able to mobilize our subcontractor to start that worK.
