Thank you for taking the time to talk to me earlier today.
I found the original email I sent to you back on Aug 25, 2011 as a response to a letter you had mailed the
residents on the west side of Alex Dr., so I am including it in today's email for reference.
In it, I mentioned two problems related specifically to my property.
1.the hill slide had already entered my property (i.e. my back yard now begins to drop off towards the
canal beginning inside my fence line). Please note, prior to the canal being built and the hill sliding, my
yard was level not only to my fence, but beyond my fence.
2.at the time of the original email, my fence was already leaning approximately 15 degrees off vertical
towards the canal as a result of the hill sliding. today, my fence is closer to leaning about 30 degrees, so
it has only continued to deteriorate over these past 2 years.
If you will notice, every fence along the east side of the canal that has experienced any significant hill sliding is
leaning towards the canal. Not due to wood rot nor shoddy post settings, but due directly to the hill sliding
towards the canal.
As I previously stated in the original email, at the time I bought my house, the land directly behind my house
was level with my yard for a long distance before reaching the banks of the natural creek that was there (much
further to the west than where the canal is now located).
I will be home this Friday (Aug 16th) if you wish to schedule a time to come by my house and see the erosion
into my property line and the severity at which my fence leans.

Thank you for your letter of Aug 23, 2011 w.r.t. the eastern and southern banks of the canal within the Enclaves
on the Parkway.
Your letter could not have been more timely for me. Over the years, the slope to the canal (which begins at my
fence line) has been slowly sliding downhill. Prior to this summer, it had already slid far enough to cause my
wrought iron fence across the back of my property to lean towards the canal. However, this summer, it has
become far worse. My fence now leans at least 15 degrees off vertical towards the canal and I am starting to
worry about my house. This morning, when I looked, the sloping now starts a few inches inside my fence.
When I bought my property in June or July of 1993, the property behind my fence was level for maybe 100+
feet before it reached the bank of the natural creek that was there. The development of the Enclaves on the
Parkway has been a mixed blessing. Instead of what could have been apartments, I now have houses behind me
and a nice stone-lined canal and nice view. Unfortunately, when the developers moved the creek to the east to
make the stone-lined canal, they were perhaps a bit over zealous in where they began the slope to the canal.
At the time, I felt they should have left maybe 3 or 4 feet level with our property lines before beginning the
slope.
Your letter could not have been more timely, because I was wondering who I needed to contact w.r.t. the hill
slide that has been on going.
I look forward to meeting with you and the contractors during your planned meetings with respect to the
proposed solution for the east bank problem.
I would like to suggest that the contractors to give some thought to giving us a 3 or 4 foot wide level shelf along
our property, held back with a retaining wall. I'm not asking for a sidewalk along that shelf, but land that doesn't
fall sharply away at the fence line would be nice.
I am also wondering if righting my fence to vertical will be included in this work?
If you or the contractors need access to my property, I will happily grant it, but would like to know in advance.
