RE: TXU Communication permit
This memo is written to inform you that TXU Communications has submitted a permit
application to install fiber optic cable on the existing TXU electric transmission facilities
along Sandy Lake Road and in the TXU easement that runs through the Riverchase and
North Lake Woodlands areas (see exhibit). I anticipate numerous phone calls concerning
the installation once the work begins on the Sandy Lake Road section. On Tuesday, August
22, 2000 City Council approved an Interim Public Right-of-way Use Agreement with TXU
Communications Telecom Services Company which allows them to install fiber optics on
poles.
The permit will be approved today with work beginning in the next few days. Also, for
your information attached is a letter signed by Ken and prepared by Bob Hagar regarding
TXU Communication responsibilities to relocate their cables as a result of any
improvements in the right-of-way requiring the poles to be relocated at no cost to the City.

RE: Right-of-Way Use Agreement for Telecommunication Fiber Optics
Dear Mr. Wilson:
Please be advised that the City has received your application and signed the Right-of-way
(ROW) Interim Use Agreement. As terms and conditions of the ROW Use Agreement, the
proposed ordinance will require that all persons who have improvements within the ROW
maintained by the City for fiber optic telecommunication lines may be required in the future
to move those lines as a result of improvements along or within the ROW as public necessity
dictates. We have released all of the permits with the caveat that any costs associated with
moving or relocating fiber optic cable within the ROW as proposed in the Interim Use
Agreement and approved by the City, will be performed at the cost of the licensee and the
City shall have no financial responsibility to move or relocate any such fiber optic line. With
this understanding, we are prepared to release the permit. Your acceptance of the permit and
payment of the fee shall constitute an agreement with the City to pay whatever costs may be
incurred as a result of removing or relocating telecommunication fiber optic cable within the
ROW as maintained by the City.
