Re: Bethel Road Project
Dear Mr. Hindman:
We received your latest agreement regarding the reconstruction of the sewer line along Bethel
Road. Based upon a review of that agreement, I am submitting to you a counter-proposal which
includes HDR Engineering contracting to reconstruct of 2775 feet of line and limiting maximum
exposure for the City to $15,000, related to the reconstruction of 475 feet of sewer line. We
must limit the risks the City could incur during the reconstruction to $15,000, for any amount
over that number would be viewed as a violation of state law regarding purchasing and
contracting per our City Attorney's instructions. We appreciate HDR's continued attempts to
resolve this matter, but feel these terms must be met in order for us to proceed in an expedient
and non-adversarial manner.
Please contact me if you have any further questions regarding our position. Once again, we
appreciate your continuing efforts to resolve this matter.

AGREEMENT
THIS AGREEMENT is made by and between the City of Coppell, Texas ("City") and HDR
Engineering, Inc. ("HDR").
WHEREAS, HDR entered into an agreement with City dated November 8, 1994 to design
sanitary sewer lines for the City, and
WHEREAS, it has been determined that approximately 3250 feet of the Bethel Road section(SS
94-02C) of sanitary sewer line is required to be reconstructed, and
WHEREAS, HDR has contracted to pay for 2775 feet (Sta. 75+03 to Sta. 47+27) of the
sanitary sewer line, and
WHEREAS, the City desires to employ the same contractor to install the remaining 475 feet
(Sta. 42+52 to Sta. 47+27).
NOW THEREFORE, in consideration of the mutual covenant contained herein and other good
and valuable consideration, it is agreed as follows:
1. HDR agrees to contract for the reconstruction of approximately 2775 feet (Sta. 75+03
to Sta. 47+27) of sanitary sewer line east of the U.S. Bulk Postal Facility.
2. The City agrees to pay directly to the contractor selected by HDR or reimburse HDR the
reconstruction costs for 475 feet (Sta. 42+52 to Sta. 47+27) of sanitary sewer line, so
long as the City's total cost does not exceed $15,000.
3. Items 1 & 2 constitute the entire agreement between HDR and the City of Coppell
concerning the Bethel Road section SS 94-02C, between Sta. 42+52 and Sta. 75+03.
IN WITNESS WHEREOF, the City and HDR have signed this Agreement this day
of May, 1996.
