SUBJECT: REQUEST FOR VARIANCE TO CONSTRUCT AN INGROUND SWIMMING POOL AT THE
ABOVE REFERENCED ADDRESS
Members Of The Council,
I am requesting a variance to enable construction of an inground pool on my property located at the address above.
I believe the supporting documents submitted satisfy both the "Variance Conditions" and the "Prerequisites for
Granting Variances"listed in Section D, Variances,of Article 4 of the Floodplain Management Ordinance#94639.
The supporting documents are listed below:
1. Partial copy of the city of Coppell topographic map showing the flood plain levels of the
subject property and surrounding areas,and;
2. A copy of the original ground elevation survey on the property.
Both these documents indicate the subject property is well above the flood plain level. The established flood plain
level is noted as 453 ft. The subject property and dwelling show to be at levels varying from 455 ft. To 457 ft.
I have also today met with the Federal Emergency Management Agency (FEMA) regarding a Letter Of Map
Amendment (LOMA) to correct the inaccuracy in the FEMA map. After reviewing the data presented they
determined that the major portion of the property is above the floodplain levels, however FEMA must go by the
lowest point on the property which is at the far southeast corner of the property. They suggested a metes and
bounds survey be done for the portion of the property that would be involved in the construction area. Based on the
survey copy enclosed it was the officer's verbal opinion that there should be no problem issuing the LOMA. I have
contacted the original surveyor of the property and this process has begun.
Though FEMA does not require local approval to issue the LOMA, the process can take 1 - 3 months even when
all evidence submitted meets their requirements. I am requesting the variance from the city now so that I may
begin immediate construction of the pool. This pool was to be my Christmas gift to my family. Had I known of the
possible problems with the permit I would have begun this process much earlier in the year. If the variance is not
granted then it is almost certain to be next year before we would be able to enjoy the use of this pool.
We would also cite the following supporting facts relating to precedence for this request:
1. The home and property just south and east of our residence,720 Deforest Rd., received a
similar variance to build a comparable pool,and;
2. The City of Coppell constructed their North Service Center immediately east of that residence,
and;
3. That both of these structures,according to the city topographic maps,lie in areas equal to or
below the levels of my property, although,according to the FEMA maps,they show to be in
the same flood plain area as my residence.
In view of the evidence presented and time and seasonal constraints we would respectfully request that the city
grant this variance. I appreciate your consideration.
